Arguments:

1. That Israel is under an obligation to terminate its breaches of international law; it is under

an obligation to cease forthwith the works of con- struction of the wall being built in the

Occupied Palestinian Territory, including in and around East Jerusalem, to dismantle

forthwith the structure therein situated, and to repeal or render ineffective forthwith al1

legislative and regulatory acts relating thereto.

2. That Israel must make reparation for all damage suffered by all natural or legal persons

affected by the wall’s construction.

3. That Israel is under the legal obligation to make reparation for all damage suffered by all

natural or legal persons affected by the wall’s construction.

4. That all States are under an obligation not to recognize the illegal situation resulting from

the construction of the wall and not to render aid or assistance in maintaining the

situation created by such construction; al1 States parties to the Fourth Geneva

Convention relative to the Protection of Civilian Persons in Time of War of 12 August

1949 have in addition the obligation while rejecting the United Nations Charter and

international law, to ensure compliance by Israel with international humanitarian law as

embodied in that Convention.


5. That it is legal obligation for all States, while respecting the United Nations Charter and

international law, to see to it that any impediment, resulting from the construction of the

wall, to the exercise by the Palestinian people of its right to self-determination be brought

to an end.

6. That all States parties to the Fourth Geneva Convention were under an obligation, while

respecting the Charter and international law, to ensure compliance by Israel with

international humanitarian law as embodied in that Convention

7. That Israel is under legal obligation to respect the right of self determination of

Palestinians under International Humanitarian law and International Human Rights Law.

8. That the construction of the wall in the Occupied Palestinian Territory has, Inter alia,

entailed the destruction of homes, business and agricultural holdings.

9. That Israel is under the obligation to return the land, orchards, olive groves and

immoveable property seized from any natural or legal person for purposes of the

construction of the wall in the Occupied Palestinian Territory.

10. That the Court will now consider the legal consequences of the internationally wrongful

acts flowing from Israel’s construction of the wall as regards the other States.
11. That the obligations erga omnes violated by Israel are the obligation to respect the right

of Palestinian people to self determination.
