11 : Release Deed

Mr.Chennakeshava Reddy and Mr.Pratap Reddy are bothers and


residents of Bengaluru. SamaraSimha Reddy the father of both brothers
died intestate on 02/11/2019 at Bengaluru leaving behind a shop which
usually looked after by the deceased and his younger son Mr.Pratap Reddy.
Chennakashava Reddy is an engineer and has sufficient source of income
from his salaries and some of his investments in the securities at stock
exchange. Pratap Reddy has the shop as the only source of his income for
his family. After the death of their father knowing the plight of younger
brother, the elder brother Chennakeshava Reddy wants to lawfully Release
his share in the common ancestral property i.e, shop in favour of his
younger brother Pratap Reddy by executing a Release Deed. Draft a Release

Assignment No.12 : Trust Deed

Mr.Sanjeev Rathod is an Ex-Army Officer residing in Bengaluru. He


has a great urge to create some avenue for the children of the Martyrs.
When he expressed his intention his friends who were his colleagues in
service shown great interest to address the said cause. They decided to from
a Trust with an objective of providing helping hands to the family and
children of Martyrs. The activities planned by the trust are:
a) Free Medical Checkup Camps,
b) Free Education and Knowledge Development.
c) Skills Development.
d) Health and Hygiene Development.
e) Cultural Development.
f) Arts, Fine Arts, Literature, Scripture & Sculpture Development.
g) Sports and Games Development.
h) Ecology and Environment Development.
i) Adoption of orphans school, old age homes,
j) Any other purpose of importance for the welfare and
understanding at Global, National, Regional, Provincial, Community
levels and dimensions.

RELEASE DEED

THIS DEED OF RELEASE is made and executed on this the


Ninth Day of April Two Thousand Nine (09.04.2009) at Bangalore,

Hereinafter collectively referred to as the “RELEASOR” of the One


Part.

IN FAVOUR OF:-

Sri. Yamanuri Reddappa,


Aged 32 years,
S/o. late Y.Siddaiah,
R/a. Sri.Haripriya,
2nd lane left, 1st Main,
Opp. Anjani Talkies,
Chintamani,
Kolar District.

Hereinafter referred to as the “RELEASEE” of the Other Part.

(The expression the “Releasor” and the “Releasee” shall mean and
include their respective heirs, legal representatives, administrators,
executors, successors-in-interest, assigns etc., wherever the context so
requires.)

WHEREAS the Releasor and Releasee are the co-owners of the


Vacant Site bearing No.22, 6th Stage, 8th Block, Banashankari
Extension, Bangalore, measuring East to West 12 meters and North to
South 9 meters in all measuring 108 meters or 1200 Sq. ft., which is

morefully and particularly described in the Schedule hereunder and
hereinafter referred to as “SCHEDULE PROPERTY”.

WHEREAS the Schedule Property was purchased by


Smt.Padmavathamma, the mother of the parties herein under a sale
deed dated 2.5.07 registered as Document No. BNG(U)-BSK/807
stored in CD No.BSKD3, in the office of Sub-Registrar, Banashankari,
Bangalore, out of her own funds. The vendor of Smt.Padmavathamma
acquired the schedule site under a sale deed dated 6.5.06 from the
Bangalore Development Authority, which is registered as Document
No. BDA-1-01661-05-06 stored in CD No.BDAD88, dated 7.5.05, in
the office of the Additional District Registrar, Bangalore Urban
District.

WHEREAS the said Smt.Padmavathamma died intestate on


13.06.08 leaving behind the parties herein to succeed to her estate.
That Sri.Yamanuri Siddaiah, the husband of Smt.Padmavathamma
and father of the parties herein also died 09.12.08. The Releasor and
Releasee are the only legal heirs to succeed to the estate of late
Smt.Padmavathamma. Thus Releasor and Releasee have equal share,
right, title and interest in the Schedule Property and are in peaceful
possession and enjoyment of the Schedule Property without any
hindrance from any quarter.

WHEREAS the Releasor and Releasee are none other than the
Brothers by relationship. That the Releasor has desired to release his
share in the Schedule Property in favour of the Releasee out of love
and affection towards his brother on his own free will and accord,
absolutely for the use and benefit of the Releasee.

NOW THIS DEED WITNESSETH AS UNDER:-

1. That in pursuance of the above and in consideration of love and
affection towards the brother, the Releasor hereby release, relinquish,
transfers, assigns and set over UNTO AND IN FAVOUR of the Releasee
his share, right, title and interest over the Schedule Property, together
with all the rights, title, interest, possession, claims, liberties, estates,
easements, ways, paths, water and water courses, heriditaments and
all other privileges appurtenant or belonged thereto, free from all
kinds of encumbrances in favour of the Releasee, TO HAVE, HOLD,
POSSESS and ENJOY the same by the Releasee hereafter wards and
forever as absolute owner without any let or hindrance from anybody
or any quarter from whomsoever, free of all encumbrances.

2. The Releasor undertakes not to interfere with the possession and


title of the Releasee in the Schedule Property or set up any claim
either on his own or through anybody else claiming through him in
future nor claim for any monetary consideration from the Releasee or
from his successors-in-interest.

3. The Releasor also agreed and undertakes to execute or cause to


be done, executed or performed all such further acts and deeds and to
execute all further deeds of assurances, confirmation or rectification
deeds so as to convey a more valid and perfect title in the Schedule
Property to the Releasee for his peaceful possession and enjoyment of
the Property, without any let, hindrances or interruption whatsoever
either by the Releasor, his successors or anybody claiming through or
under him.

4. That the original title deeds pertaining to the Schedule Property


are already in possession of the Releasee.

SCHEDULE PROPERTY
All that part and parcel of the vacant site bearing No.22, 6 th
Stage, 8th Block, Banashankari Extension, Bangalore measuring East
to West 12 Mtrs. and North to South 9 Mtrs. in all measuring 108 Sq
Meters or 1200 Sq. Ft. and is bounded;
East by : Road
West By : Site No.60
North By : Site No.21
South By : Site No.23

IN WITNESS WHEREOF, the parties herein have signed this


Release Deed on the day, month and year first above mentioned.
