Summative Assessment # 2: CONSTRUCTION DISPUTES AND RESOLUTION

 How can we possibly reduce the incidence of claims and disputes in construction
contracts?

According to a research, the most common dispute when it comes to


construction is financial relations, the cash flow, qualification of teamwork, lack of
interpersonal skills etc. Another cause is not delivering the project on-time leading to an
extension of time, this can be because of failure to submit proper documents, poor
workmanship, incomplete drawings and specifications.

There are many ways to reduce these issues without consolidating into one side.
There should be a constant briefing to clarify points that need notice and make sure
everyone understands the contractual notice provision.

Owners should be clear on their needs and requirements before designing phase
is started, to avoid misunderstanding and additional workload. Owners should be given
the resources to monitor the workers’ performance to prevent problems to escalate and
prevent dispute.
