09.09.2010, on the subject cited above.

It is submitted that case FIR No.294 dated 28.6.10 u/s 302/365/380

PPC PS Rajana, was registered at the instance of Mst. Nimat Bibi applicant. The facts in

brief are that Mst. Nimat Bibi produced an Affidavit mentioning therein that on 7.8.10

police party knocked the door of her house, when she opened the door, police party

binded her husband namely Mohammad Sharif. In the meanwhile, ASI Munawar Hussain

searched her house and took out Rs.35000/- from her purse, afterwards, police party

arrested Mohammad Rafique, Zulfiqar, Iftikhar, Sadiq and Aqib and took them at

Kasowal.

On 8.2.08 Bashir @ Bagga, Sharif @ Sheefa and Anwar driver,

who were coming back after seems Sadiq Ali and Iftikhar, ASI Munawar Hussain he will

told about Sharif husband of applicant, at Sham Welay, at 9:10 PM ASI Munawar

Hussain contacted telephonically with Bashir @ Bagga and asked him for taking her

husband Sharif, on 9.2.08 Bashir @ Bagga etc went to take him, when they reached at

Londo-Pull situated between Kamalia Rajana Raod, police party also arrested them. On

morning she came to knowledge through Tele Vision News that above said persons have

been killed.

SI Mushtaq Hussain in compliance with the order of Honourable

Chief Justice, Lahore High Court, Lahore, registered above said case and conducted

investigation, afterwards, the above said case placed before District Standing Board and

investigation of said case was changed vide Additional Inspector General of Police,
Punjab, Lahore, order No.69807-11/Inv/HC dated 8.9.10 and investigation was entrusted

following officers:-

1. Mr. Shehzad Akbar, SSP/District Police Officer, Toba Tek Singh,


(Chairman)
2. Rana Ahmad Hassan, SSP/RIB, Faisalabad.

After the transfer of Mr. Shehzad Akbar the then District Police

Officer, Toba Tek Singh, on 1.11.10 the undersigned alongwith SSP/RIB, Faisalabad, are

conducting the investigation of above said case and parties have been called for 1.11.10,

which will be finalized purely on merit in the light of evidence produced by the parties.

It is further mentioned here that Inspector Mohammad Yaqoob has

been strictly directed to avoid from interference in the investigation of above said case.

It is pertinent to mention here that the investigation of cases FIR

No.58 dated 10.2.08 u/s 324/458/398 PPC & 13/20/65-AO PS Ghala-Mandi Sahiwal and

No.16 dated 20.1.09 u/s 302/365/380 PPC PS Kasowal was conducted by Investigation

Crime Branch Lahore and during investigation, it was found that occurrence has taken

place in the area of PS Rajana District Toba Tek Singh. Consequently, above noted both

cases were cancelled and case FIR No.293 dated 28.6.10 u/s 302/365/380 PPC PS Rajana

was registered. Investigation of the same will be finalized purely on merit, submitted,

please.

heard the parties and reported that applicant Mohammad Saleem and his accomplices

accept Mst. Yasmin and Mst. Sahiba have been found guilty. He further mentioned in his

report that allegations leveled in subject application have been found false and fabricated.

The said officer subject matter relates to case FIR No.340 dated

28.09.2006 u/s 302/396/397 PPC PS Sadar Kamalia. During investigation, applicant

Mohammad Mosa joined the investigation and was found guilty, challan of the above

said case has been sent to the court for judicial verdict, which is under trial, at this stage

registered at PS City Gojra. Case FIR No. FIR No.753 dated 14.11.2010 u/s 382 PPC PS

City Gojra has been cancelled and cancellation report has been prepared.

It is submitted that upon receipt of subject application, DSP/SDPO,

Gojra, was directed to probe into the matter and report.

The said officer reported that subject matter relates to case FIR

No.716 dated 23.11.2009 u/s 324/34 PPC PS City Gojra. He called both the parties,

perused case file and reported that facts in brief are that allegedly on 23.11.2009 Sajid

Mehmood s/o complainant Riasat Khan was coming to his village on a bicycle. Accused

Amaan Ullah, Zaka Ullah and Mohammad Tufail were sitting on the way, who were

armed with fire arm weapons, Mohammad Tufail accused stopped Sajid Mehmood and

raised lalkara that he be killed, accused Amaan Ullah injured him with gun 12 bore. The

occurrence was witnessed by Dildar Hussain and Atta Mohammad PWs.

Mohammad Aslam Inspector investigation PS City Gojra

conducted the investigation of this case. During investigation, accused Amaan Ullah,

Zaka Ullah and Mohammad Tufail were declared POs. Incomplete challan of this case u/s

512 Cr.PC has been submitted in the court. Afterwards accused Mohammad Tufail was

arrested while arrest of Zaka Ullah is pending and challan against him has been submitted

in the court, which is under trial.

SHO and I.O have been directed to arrest of Zaka Ullah PO and

finalize the investigation purely on merit, please.

Subject:- LATEST STATUS OF CASE FIR NO.154/10 U/S 302 PPC PS


SADAR KAMALIA.

Memorandum:-

Kindly refer to your office Letter No.PSO/CMS/2-34/2008 dated

25.05.2010, on the subject cited above.

It is submitted that upon receipt of subject application, latest

progress report was called from SHO PS Sadar Kamalia regarding case FIR No.154/10

u/s 302 PPC PS Sadar Kamalia. Who submitted as under:-

a) Case FIR No.154/10 u/s 302 PPC PS Sadar Kamalia was registered

of Shahid Hayyat, which was registered regarding the murder of

Mazhar Hayyat against Waris Ali etc (9 in number).

b) Accused Waris Ali, Ali Hamesh, Ahmad Yar, Qalab-e-Abbas,

Mohammad Yousaf, Mushtaq, Sakhi, Allah Ditta have been arrested

and sent to judicial lock-up. While accused Mohammad Younis was

declared as PO during investigation, who has been killed in police

encounter in the area of Police Station Sadar Gojra. Arrest of only

once accused namely Mohammad Yousaf is pending, who has been

declared as PO.

DSP/SDPO, Kamalia, has been strictly directed to arrest the

remaining accused and finalize the investigation of this case purely on

merit, please.
