Argumentative Research Paper Topic Proposal

What law/policy are you interested in researching? Include the name and the wording of the law.
I am interested in researching laws concerning abortion in the state of South Carolina, primarily during the third trimester. Section 44-41-10 quotes "During the third trimester
of pregnancy, the abortion is performed with the pregnant woman's consent, and if married and living with her husband the consent of her husband, in a certified hospital,
and only if the attending physician and one additional consulting physician, who shall not be related to or engaged in private practice with the attending physician, certify in
writing to the hospital in which the abortion is to be performed that the abortion is necessary based upon their best medical judgment to preserve the life or health of the
woman. In the event that the preservation of the woman's mental health is certified as the reason for the abortion, an additional certification shall be required from a
consulting psychiatrist who shall not be related to or engaged in private practice with the attending physician. All facts and reasons supporting such certification shall be set
forth by the attending physician in writing and attached to such certificate."
What topic does this law cover?
This law covers the requirements someone must go through during their third trimester of pregnancy to abort their baby. It also covers the conditions that such person must
be in to abort their baby as well.

What information do you already know about this law/policy?

I don't know to much about this law, other than what is given in the law itself such as:
•consent of woman and spouse
•the hospital is required to agree to the fact that the abortion is in their best judgement to save the life of the woman
•reasoning behind the abortion must be provided as well
•it is illegal for medication to be administered to abort the fetus
Along with that, I know that many lawmakers in South Carolina are looking to greatly limit abortion laws, to prevent them at almost cost.

How could this law/policy limit someone’s freedom?

This law could limit the freedom of choice made by a woman in her third trimester, who possibly wants to terminate her pregnancy, whether it be for financial reasons or if the
fetus is suffering from serious problems before birth, and would most likely live a short and difficult life. The laws explicitly only regard termination during the third trimester
the mother must be in danger, rather than the baby.

How could this law/policy protect someone?

This law protects the life of the unborn fetus and possibly even the mother under some circumstances. It might actually protect the status of those who perform the abortion
as well, as they wouldn't get slashed for performing an abortion.

•as studied in 2002, 7 women died during an abortion out of a study of 100,000, however no further studies concerning the death of the women have been conducted
•17-28 women die during birth out of around 100,000
