The IRENA Statute

The Parties to the IRENA Statute,

o convinced of the major role that renewable energy can play in reducing
greenhouse gas concentrations in the atmosphere, thereby contributing to
the stabilisation of the climate system, and allowing for a sustainable, secure
and gentle transit to a low-carbon economy,
o desiring to foster the positive impact that renewable energy technologies
can have on stimulating sustainable economic growth and creating
employment.

Increased use of fossil fuels without actions to mitigate greenhouse gases will
have global climate change implications. Energy efficiency and increase use of
renewables contribute to climate change mitigation and disaster risk
reduction. Maintaining and protecting ecosystems allow using and further
developing hydropower sources of electricity and bioenergy.

1.3 That domestic law may not be questioned on the grounds of


contravening international commitments
7. International customary law is part of municipal law unless it is
inconsistent with municipal law in which case municipal law prevails over
international law.1 Municipal Courts are bound by domestic statute and
international law cannot confer any rights which are cognizable in municipal
courts.2 Therefore, for an international treaty or convention can only be
judicially enforceable by legislative action to that effect. 3 In Union of India v.
Azadi Bachao Andolan,4 it has been unequivocally held that any international
agreement or treaties which are binding upon the state are not by themselves
binding on Indian nationals and such agreements must be transformed into
domestic law by legislation.5
