LEASE CONTRTACT

KNOW ALL MEN BY THIS PRESENTS:

This Lease Contract is entered into by and between:

____________________, of legal age, Filipino citizen, and with residence and postal
address at____________________________________, hereinafter referred to as the “LESSOR”,

-and-

__________________________________, herein represented by_________________,


Filipino citizen, and with residence and postal address at _______________________________,
hereinafter referred to as the “LESSEE”,

RECITALS

1. LESSOR is the legal owner of the Three- storey building located at Galas-Maasim, San
Rafael, Bulacan, Philippines, with full power and authority to enter into lease thereon or
otherwise administer the same.

2. LESSEE desires to lease from the LESSOR the Second and Third Floor of the aforesaid
building, and the parties have agreed to enter into a lease of agreement defining all rights,
duties, and liabilities of the parties threin.

NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS


CONTAINED HEREIN, the parties agree as follows:

1.0. LEASED PREMISES

1.1. LESSOR agrees to demise and rent unto to LESSEE the Second and Third Floor
of the said building, with a total floor area of Eight hundred twenty five square
meters, more or less, as shown in the drawing attached herewith.

2.1 PURPOSE OF LEASE

2.1. The LEASED PREMISES shall be used by LESSEE solely in the conduct of the
business of an educational institution, and all activities related thereto.

2.2. LESSEE shall not use the premises for any other purpose nor for any illegal,
immoral, ultra-hazardous activity, whether within or outside the scope of the business of
LESSEE.

2.3 LESSOR and LESSEE agrees to convert the Second floor and Third floor of the
building into an educational institution by providing the following facilities:
Second floor facilities :
• Registrar’s Office/Administrator’s Office
• Student Lounge
• Clinic
• Library
• Kitchen
• Mess Hall
• Male and Female Restrooms
• Corridors

Third floor facilities :


• Three (3) Classroom units
• Office/ Faculty room
• Storage
• Male and Female Restrooms

2.4 LESSOR and LESSEE agrees on the building facilities’ specifications stated as
follows:

• All classroom units and offices shall be equipped with internet connections.
• Electrical rough-ins for Air conditioning units shall be installed.
• Interior and exterior ceiling works shall be using Hardiflex boards fastened on
galvanized metal joists.
• Dry wall partitions shall be Marine plywoods fastened on galvanized metal frames.
• Windows with clear glass in aluminum frames shall be provided on classrooms and
offices.
• Safety railings on staircase, windows and corridors shall be installed.
• Sufficient lighting and power supply shall be provided.
• Male and Female restrooms shall be provide with safety railings/ grab bars.
• Plumbing and Lighting fixtures shall be provided/installed by the Lessor

***All other requirements not stated herein shall be at the LESSEE’s expense.

3.0 TERM OF LEASE

3.1. The term of this lease shall be beginning on the date of the building’s turnover to the
LESSEE and shall be expiring after an exact period of Three years, unless sooner terminated for
breach of the terms and conditions of this contract.

4.0 RENT

4.1 Upon the execution of this agreement, LESSEE shall pay the LESSOR the sum of Six
Hundred Thousand Pesos (600,000.00 Php), equivalent to the LESSEE’s One year rental as
guarantee of the LESSEE’s interest to rent the building and to for the provision of the LESSEE’s
requirements prior to occupancy.

4.1.1. The LESSOR shall start the construction of facilities and renovation of the building
upon affectivity of this contract and upon receipt of the LESSEE’s advance payment of Six
Hundred Thousand Pesos (600,000.00php)

4.1.2. The LESSOR shall commit to the LESSEE the duration of 60 working days for the
building’s construction/renovation
4.2 LESSEE shall pay the LESSOR a monthly rent of Fifty Thousand Pesos
(50,000.00Php) for using the Second Floor and Third Floor of the building. The monthly rental
shall be payable without the need of demand or any act or deed, at the above address of the
LESSOR within the first five days of each month, after the building’s turnover to the LESSEE.
Monthly payment shall begin two months before the end of its First year of lease and shall be
continuing up its Third year.

4.2.1. The LESSEE agrees that the amount of monthly rental fee shall remain the same
for Three consecutive years

4.2.2. The LESSEE agrees that a Ten Percent (10%) increase on its monthly rental shall
be imposed by the LESSOR yearly after the Third year of rental.

5.0 SERVICE AND UTILITIES.

5.1. LESSOR shall extend assistance to LESSEE in securing separate water and electrical
connections to the leased space including execution, signing, and submission of requirements
imposed by the utility companies. The cost of such installations shall however be for the account
of the LESSEE, but any deposit or investment required thereon shall be\endorsed or assigned by
the LESSOR in favor of the LESSEE.

5.2. All other utilities required by LESSEE on the premises, including janitorial and
telephone services, shall be obtained by and at the expense of the LESSEE.

6.0. ALTERATIONS, ADDITIONS OR IMPROVEMENTS

6.1. LESSEE is authorized to renovate the leased premises in accordance with the plans
and specifications approved by the concerned authorities, and to suit the business requirements
of LESSEE. LESSEE shall not make other alterations, additions, or improvements on or to the
premises without first obtaining the consent of the LESSOR, and all alterations, additions and
improvements that shall be made shall be at the expense of LESSOR prior to the LESSEE’s
occupancy, and shall remain on the premises as part thereof at the termination of this Lease and
shall remain as property of the LESSOR

7.0. ACCESS TO PREMISES

7.1. LESSEE shall allow the LESSOR or his/her agents or employees the free access to
the premises at all reasonable times for the purpose of inspecting or of making repairs, additions,
or alterations to the premises.

8.0. DEFAULT BY LESSOR

8.1. If the LESSOR fails or neglects to perform his obligations under the agreement, then
LESSEE may, after reasonable notice in writing of not less than 30 days, terminate this lease.

9.0. DEFAULT BY LESSEE

9.1. If any rents shall be and remain unpaid when these rents shall become due, or if
LESSEE violates or defaults in any of the provisions of the Lease. Then LESSOR may cancel
this lease by giving the notice required herein, and re-enter the premises, without prejudice to his
right to forfeit the guarantee deposit as provided as provided hereinabove.
10.0. WAIVER OF BREACH

10.1. The waiving of any of the provisions of this lease by any party shall be limited to
that particular instance involved and shall not be deemed as waiver of any other rights or any
other term of this lease.

11.0. TERMINATION AND SURRENDER

11.1. LESSEE shall surrender the premises within 30 days from receipt of notice of
termination of this lease, or on the last day of the term or expiration of the lease.

12.0. REMOVAL OF PERSONAL PROPERTY

12.1. LESSEE shall have the right to remove all personal property, trade fixture and
equipment, whether attached to the premises or not, provided that these items can be removed
without damage to the premises.

13.0. SUCCESSORSAND ASSIGNS

13.1. The covenants and stipulations of this lease shall be binding on the successors and
assigns of the LESSOR and on the successors-in-interest and assigns of LESSEE.

14.0. NOTICES

14.1. Except as otherwise required by statute, all notices required to be given pursuant
hereof may be sent thru correspondence and emails.
