SUBJECT : Progress and Final Report

1. Reference:
a. Spot Report dated 07 March 2020, re-subject same as above.

2. ICOW the above cited subject and reference, please be informed that on or about
10:30 P.M. of March 6, 2020 in the University of Batangas, Lipa, Batangas, a rape incident
transpired wherein victim identified as one ANDREA AL ALAWI, 20 years old, single,
student, a native of Lipa and presently residing at Lipa, Batangas, was raped and killed by the
suspect identified as one EPREN ELFIN AFAM BERIAS, aka “Elfin”, X years old, single,
law student, a native of Calamba and presently residing at Calamba, Laguna.

3. Initial investigation conducted showed that at around 9:40 P.M. of March 6, 2020,
the victim was seen by S.G. Noli Katigbak walking around the back of Building B of the
University of Batangas with the suspect. At around 10:45 P.M., Elfin was seen exiting the
premises of the university. It appears that around this time, Brooks Lee, a construction worker
living in the premises of the University, was awakened by his brother, Stonks Lee, who
communicated that he saw a man on top of a woman in the nearby construction site (Building C).
The latter relayed that the woman was screaming “Aray, masakit! Anong ginagawa mo, Elfin,
umalis ka dyan!” and that the man was trying to prevent her from struggling by holding her in
her wrist and arm. Thereafter, the man, according to Stonks, took hold of a nearby piece of
hollow block, and said to the woman,” ‘Pag di ka tumigil, papatayin kita!”. The woman
continued to struggle; the man subsequently hit the woman in the head with the same piece of
hollow block two times. After the first hit, the woman stopped struggling and seemed
unconscious. The man then dragged the woman and placed her inside the cement mixer about 5
meters away from where they were;

4. Upon knowledge of this, Brooks informed the guards of the University as to the
incident relayed to him by his brother. A search was conducted within the premises pointed by
Stonks. It appears that at the time of the search, the parent and sister of the victim was already in
the University looking for Andrea together with S.G. Noli Katigbak, one of the University’s
guards. The lifeless body of the victim was found inside the cement mixer, near the construction
site. The police were called by the security personnel of the University and the latter arrived at
11:30 P.M.. Her body was brought in the nearest hospital for post-mortem examination;

5. Medico Legal examination conducted by J.N. Llana M.D revealed that the victim
has two wounds in the right side of the forehead, the internal hemorrhage of which caused her to
die. Her vaginal canal was also found to have had seminal discharge, and lacerations on 3, 6, 9
and 12 o’clock. Her body was covered with small bruises, but more prominent ones were found
in her wrist and arm area. The toxicology report revealed traces of trichloromethane in her
oropharynx;

6. DNA test conducted by Dr. Llana as to the semen found in the victim’s vaginal
canal as well as the skin fragments under the victim’s fingernails revealed a positive match to the
suspect’s DNA.

7. That, based on the aforesaid result, a complaint for “RAPE WITH


HOMICIDE” which is defined and penalized under Art 266-A in relation to 266-B of the
Revised Penal Code (RPC) of the Philippines was charged against suspect Epren Elfin Afam
Berias before the office of the Provincial Prosecutor, Province of Lipa.
