MOTION TO APPROVE AUTHORITY TO PROSECUTE CRIMINAL CASE

COMES NOW, the undersigned counsel unto this Honorable Court most
respectfully states that:

1. The prosecution of this instant case is under the direction and

control of the Public Prosecutor.

2. The Public Prosecutor has a heavy work schedule considering that

she is handling cases before other courts in addition to the constant
conduct of Preliminary Investigations, Inquest Proceedings,
Investigations re collusion as well as preparation for the required
Resolutions, Inquest Reports and Investigation Reports, among others;

3. As such and pursuant to Supreme Court A.M. No. 02-2-07-SC in

relation to Department of Justice Memorandum Circular No. 25 dated
April 26, 2002, authority to prosecute this criminal case has been given to
the undersigned counsel for him to continue to prosecute said case until
the end of the trial unless said authority is withdrawn or otherwise
revoked;

4. That the undersigned counsel has been authorized to prosecute this

criminal case in writing by the City Prosecutor, as evidenced, attached
herewith as Annex “A”.

PRAYER

WHEREFORE, it is respectfully prayed of this Honorable Court that

the Authority to Prosecute is given to the undersigned counsel be
approved.

Such other reliefs just and equitable under the premises are also
prayed for.
