l-. The court has jurisdictj-on over the subject matter
and of the parties hereto.
2. Amy Atwood Frazier and Harris Claiborne Fral-zer
v/ere formerly husband and wife and were divorced by
.Tudgmentof Divorce rendered in this action on
November 29, 2007, and filed on February 11, 2008.

3. Harris Claiborne Frazier did not appear or

participate in the trial of the divorce. Amy Atwood

Frazier was awarded certain asseLs based upon her

knowled.ge of trre assebs at the time of the dj-vorce
hearing on November , 2007. f n the ,Judgment of

Divorce Amy Atwood Frazier was awarded '14 of Harris

Claiborne Frazier' s 401- (K) Plan. It has been
determined that Harris Claiborne Frazj-er had no

funds in a 4Of(K) Plan at the time of the divorce.

the parties l-ocated at L44 Overlook Point.e,

Madison, Mississippi. This marital home had

previously been conveyed and was not owned by the

parties at the time of the divorce.
Amy Atwood Frazier had loaned to Harris Claiborne
Frazier the sum of $l-20,000.00 from non marital-
asseLs. Amy Atwood Frazier should be awarded a
judgmenL against Harris Ciaiborne Frazíer in the
sum of $120,000.00 together with interest at the
1egaI rate.
5. Harris Claiborne Frazier is the owner of an

j-nterest, in Mathena WeLlands, LLC, a Mississippi

Limited Liability Company.Amy At,wood Frazier
should be awarded Harris Claiborne Frazier's
interest in Mat.hena Wetlands, LIJC. Harris Claiborne
Frazier is the owner of an undivided two-t,hirds
(2/3rds) interest in Frazier Development, LLC, a
Mississippi Limited Liabilit.y Company. Amy Atwood
F'razjler should be awarded one-ha1f (%) of such

interest, owned by Harris Claiborne Frazier in

Frazier Development, Ll,C. That such interests
awarded to Amy Atwood Frazier will properly adjust
the equitable distribution attempted to be made at
the divorce hearing in this matter.
6. That all other terms of the Judgment of Divorce
should remain the same.

IT IS, THEREFORE, ORDERED .A.I{Ð ÀD,JUDGED, that the .Tudgment

of Divorce rendered in this act.ion on November 29, 2007, and

fil"ed in this action on February LL, 2008, be, and the same

hereby is, amended by providing that. Amy Atwood Frazier be

awarded t.he interest of Harris Claiborne Frazier in Mathena

Wetl-ands, LLC, a Mississippi liability company, and by
awarding unto Amy Atwood Frazier one-hal-f H) of t,he interest
of Harris Cl-a-iborrre Frazier in Frazier Dewelcpment, LLC.

IT IS, FURTHER, ORDERED ÀìID A¡.TIIDGED, that Amy Atwood

Frazier be awarded a .Tudgment in the sum of $120,000.00
together wíth interest at the 1ega1 rate against Harris
Claiborne Frazi-er.
