AFFIDAVIT
OF DESISTANCE

I, CIRILA AZURIN ALUDINO, of legal age, Filipino citizen and with

residence and postal address at Quezon Avenue, Brgy III, Vigan City, Ilocos Sur
after having been duly sworn to in accordance with law, hereby depose and state;

That I have earlier filed a criminal complaint for ESTAFA THRU

FALCIFICATION OF COMMERCIAL DOCUMENTS against the hrein accused
Marlyn Guquib et. al. docketed as Criminal Case No.s. 5961-V, 5962-V and 5963-
V which are now pending before the Regional Trial Court, Branch 21, Vigan City,
Ilocos Sur;

That after much reflection, I realized that I have misappreciated the facts as I
have narrated in my sworn statement and that the incident that actually happened
does not indicate or p[rove that indeed estafa had been committed by the accused
Marlyn Guquib;

That in addition, I have no more witnesses on my side who are willing to

testify, hence, it would be difficult if not impossible for me to prove the guilt of the
accused Marlyn Guquib beyond reasonable doubt;

That I am executing this affidavit to attest to the truth of the foregoing and to
pray the Regional Trial Court, Branch 21, Vigan City, Ilocos Sur to dismiss the
complaint against me with prejudice due to the reason above-cited;
