7.DEVOLUTION OF TITLE :-

during last 13 years / from Origin (tracing of the title should be explained in
chronological order beginning with the earliest available title deed. All the title
deeds should be discussed fully, stating registration number, document number,
dates of execution, name of executors and executants, etc. & complete history of
mutation entries, village records. The chain of title deeds should clearly
establish the title of the property holder. If the chain is broken, the same should
be explained in convincing manner.)]:-
1. The recital of the deed & document indicate that Gholi s/o Bajrangi was
owner of property aaraji no. 108 min., Situated at Mauja – Jungle Shivpur
urf Sahbajganj, Tappa Khuthan Pargna Haveli Tah. Sadar, Distt. Gorakhpur
with transferable right since 1360 fasli .
2. Thereafter as per order dated 29.08.2011 S.D.M. Sadar Gorakhpur vide case
no. 237/450 u/s 33/39 the correct name of Gayasuddin s/o Nizamuddin
and Zaid & Anas s/o Gayasuddin entered in khatauni in place of Gholi
s/o Bajrangi.
3. Thereafter Gayasuddin s/o Nizamuddin & Anas s/o Gayasuddin executed
registered agreement to sale dated 22.10.2011  in favour of  Vinod Kumar
Sharma s/o Late Sri Ram Vriksha Sharma aaraji no. 108 min. area 1308 sq.
feet Situated at Mauja – Jungle Shivpur urf Sahbajganj, Tappa Khuthan
Pargna Haveli Tah. Sadar, Distt. Gorakhpur which is registered in the office
of sub registrar Gorakhpur at Bahi no. 1 serial no. 7696.
4. Thereafter Gayasuddin s/o Nizamuddin & Anas s/o Gayasuddin executed
registered sale deed dated 30.12.2011 in favour of  Vinod Kumar Sharma
s/o Late Sri Ram Vriksha Sharma in respect of aaraji no. 108 min. area 1308
sq. Feet which is registered in the office of sub registrar Gorakhpur at Bahi
no. 1 Zild no. 8734  page no. 75 to 112, serial no. 9665
5. Thus I am of the view that Vinod Kumar Sharma s/o Late Sri Ram Vriksha
Sharma is owner of aforesaid property. Vendee is major so no minor
interest is involved in the property. The chain of title is complete.

feet, Situated at Mauja – Jungle Shivpur urf Sahbajganj, Tappa Khuthan Pargna Haveli
Tah. Sadar, Distt. Gorakhpur. The subject property is free from all kind of
encumbrances, lien, charges, mortgages, etc. and Vinod Kumar Sharma s/o Late Sri
Ram Vriksha Sharma  shall get valid, absolute, clear and marketable title to the said
shop/property can create a valid mortgage in favour of PNBHFL. The said
Property/mortgage can be enforced (if required) under the provisions of The
Securitization and Reconstruction of Financial Assets and Enforcement of Securities
Act, 2002 and amendments thereto (“SARFAESI”) by PNBHFL.
