OMNIBUS MOTION
(1) TO REVIVE CASE;
(2) TO SET FOR ARRAIGNMENT; and
(3) TO SET ASIDE THE WARRANT OF ARREST

COMES NOW, Accused, -----------------------------, and unto this Honorable


Court most respectfully manifests that:

1. On August 17, 2015, an Order for the arrest of the accused and sending the
case to the archives was issued by this Honorable Court;

2. The accused failed to attend the scheduled hearing of the instant case because
he was not able to receive any notices from the Honorable Court;

3. The accused already settled the fine for violating the Anti-Littering Law-
Malabon City in the amount of Five Hundred Pesos (Php 500.00) on January
17, 2020. The Official Receipt issued by the Office of the Treasurer- City of
Malabon is attached herewith as Annex “A”;

4. The accused has no intention to delay and defy the lawful orders and
processes of this Honorable Court. If he was aware of the scheduled hearing,
he will surely attend the set date;

5. Further, the accused prays that the instant case be revived and upon revival of
this case, it is prayed for that the accused be set for arraignment and his
warrant of arrest be set aside by the Honorable Court.

PRAYER
WHEREFORE, it is most respectfully prayed of this Honorable Court that
the motion in the instant case be granted.

Other reliefs just and equitable under the premises are likewise prayed for.
