Subject: House Energy Meter – Engineer’s Letter ref. CA/ATCC0/2675/CA272/2020

Dear Sir,
Reference is made to your letter ref. CA-ATCCO-2675-CA272-2020 dated 4-Mar-2020 pertaining to
the above subject, we respond to you as follows:

1. We are surprised to learn that, in your opinion, the word “operator” mentioned in the drawings
is mean less and irrelevant to this argument due to the fact that all the AOR considered in all his
responses to our correspondences the operator means Contractor which is completely not in
line with related Contract documents as we notified you numerously in our previous
correspondences and meetings relating to this subject. On other hand, we notify you that you
misinterpreted what have been mentioned in the raiser diagram, for clarity purposes, please note
the followings:

 “Each FAHU will be provided by the following house energy meters by the Operator
billed, 1- one meter for chilled supply 2- one meter for heating supply”. Which mean that
these meters (65mm) will be provided by the Contractor and billed by operator. Accordingly, all
these meters have been reflected and considered in the B.O.Q rates.
 “Each FCU will be provided by the following house energy meters by the Operator Billed,
1- one meter for chilled supply 2- one meter for heating supply”. Which mean that these
meters (15mm-25mm) will be provided by the Contractor and billed by operator, Accordingly, all
these meters have been reflected and considered in the B.O.Q rates.
 “One house energy meter for Clarifiers provided and billed by the operator”. Which mean
that these meters (150mm) will be provided and billed by the operator, Accordingly, all these
meters have not been reflected or considered in the B.O.Q items and rates also not mentioned
in the related Specifications.
 “One House energy meter for chilled water and one house energy meter for heating will
be provided by the operator to verify the JDE bill”. Which mean that these meters (250mm)
will be provided by Operator, Accordingly, all these meters have NOT been reflected or
considered in the B.O.Q items and rates also not shown in the related IFC Drawings and the
related Specifications.
2. Again, the house energy meters listed under item ref. (B1/3/5-J) of the additional B.O.Q are part
of the house energy meters for the FCU’s and AHU’s in the buildings which clearly shown in the
related IFC Drawing. Which means that such meters were missed from the original B.O.Q items
and none of these energy meter were related to the clarifiers or the heat exchangers, the detailed
quantities are as follows:
 Total energy meters in all B.O.Q’s = 522 no. which were considered from the below:
- B.O.Q no. 3 item C the total quantity = 516 no.
- B.O.Q no. 3 last item in page “2” quantity = 6 no.
 Total energy meters from the IFC Riser diagram drawings = 522 no.
- Energy meter for FCU’s = 248X2 = 496 no.
- Energy meter for AHU’s = 2X 2 = 4 no.
- Energy meter in ground floor =11X2= 22 no.

Based on above, we confirm our position, established vide our all our related letters, remains
unchanged and we hereby officially re-request you to issue a clear Engineer’s instruction in order to
proceed accordingly and avoid any further delay noting that all the related works are disrupted due to
reasons totally not attributable to the Contractor.

We reserve all our contractual rights regarding this matter.
