Subject : Declination of Additional Scope of Work under Engineer’s Instructions

with reference nos. EI/GC/B3/019 Rev A, EI/GC/B4/003 Rev A and
EI/GC/B3/018 Rev A (Response to XXXX/XXX-2019-070 dated 27
February 2019)
XXX Airport Construction Project

Dear Mr. XXX,

Reference is made to the Contractor’s correspondence with ref. no. XXXX/XXX-2019-070 dated 27
February 2019, wherein Subcontractor was requested to reconsider the Engineer’s Instruction
and to submit the cost proposals intended for the following transmitted Engineer’s Instructions:

1. EI/GC/B4/003 Rev A dated 18 February 2019, Installation of alarm bell at the Firefighting
Equipment Garage of Fire Station and Maintenance (FSM) Building;
2. EI/GC/B3/019 Rev A dated 18 February 2019, Installation of push button switch at the
Control Tower (CTO) VRF Room for the alarm bell at the Fire Station and Maintenance
(FSM) Building; and
3. EI/GC/B3/018 Rev A dated 15 February 2019; Architectural works for the stair opening at
the Control Tower (CTO) VRF Room for the alarm bell at the Fire Station and
Maintenance (FSM) Building

Upon reconsideration on the foregoing instructions, Subcontractor would like to remain its
previous stance that such provision of additional items cannot be complied and executed by the
Subcontractor. Subcontractor reiterates the following reasons of declination:

1. Prolonged Procurement of Permanent Materials

2. Demobilized Equipment
3. Inadequate Manpower at Site

It has come that Subcontractor has made the most appropriate decision for the good of both
Contractor and Subcontractor, considering the aforementioned reasons, to decline this variation
issued by the Engineer pursuant to the GCC Sub-clause 13.3 Variation Procedure.

Subcontractor is hoping that Contractor finds above in order.
