Sample Memorandum Circular

Prescribing the Guidelines in the Prescription of Actions and the Suspension of Reglementary Periods to
Submit Compliances, Corrections, and Other Documents

WHEREAS, Republic Act No. 11469, or the "Bayanihan to Heal as One Act" enacted on 24 March 2020,
promotes policies and purposes to mitigate the adverse effects of COVID-19 to social, economic, and to
financial aspects.

WHEREAS, Section 4 (z) of said Act, stipulates to move statutory deadlines and timelines for the filing
and submission of any document, the payment of taxes, fees, and other charges required by law, and
grant of any benefit, to ease the burden on individuals under Community Quarantine.

WHEREAS, Section 1 of Administrative Order No. 30, Series of 2020 (AO 30) of the Office of the
President directed all government offices and agencies to formulate and issue guidelines on the
interruption of periods for filing documents and cancellation of proceedings.

WHEREFORE, the following guidelines shall be observed in all programs, projects, and proceedings
before the National, Regional, and Provincial or District Offices, and City or Municipal covered by the
Enhanced Community Quarantine (ECQ), Modified Enhanced Community Quarantine (MECQ), General
Community Quarantine (GCQ), and Modified General Community Quarantine (MGCQ):

Section 1. Suspension of Prescriptive Periods. The prescriptive periods for the commencement of
actions, complaints, and other proceedings before the National, Regional, and Provincial or District
Offices, and City or Municipal shall be suspended reckoned from the date of declaration of ECQ in the
area and shall begin to run when the MECQ is lifted and forty-five (45) days thereafter. As such, all
actions, complaints, and other proceedings that have become due shall be acted upon within the forty-
five (45) day period.

Section 2. Extension of Validity of Certificate for Business. All FSIC for Business whose application for
renewal or extension may not be filed, processed, or are pending approval due to the ECQ shall be
extended until the lifting of the MECQ and sixty (60) days thereafter. Filing of application for renewal or
extension shall be made within that sixty (60) day period.

Section 3. Suspension of Appealed Cases. All Appealed Cases to any of the Higher Offices shall follow the
rule provided in Section 1 of this Circular and shall continue thereafter.

Section 4. Exception. Notwithstanding the provisions of this Circular, reglementary periods and
proceedings for urgent cases that are necessary to enable to act expeditiously on matters affecting the
current public health emergency shall not be interrupted or canceled.

Section 5. Separability Clause. If any part, section, or provision of this Circular is held invalid or
unconstitutional, other provisions not affected thereby shall remain in full force and effect.
Section 9. Repealing Clause. All Circulars or previous guidelines on the prescription of actions and
reglementary periods which are inconsistent with the provisions of this Circular are hereby repealed or
modified accordingly.

Section 10. Effectivity. This Circular shall take effect immediately upon approval.
