General Principles
Article
1 This Law is enacted, in accordance with the
Constitution of the People’s Republic of China, the Basic Law of the
Hong Kong Special Administrative Region of the People’s Republic of
China, and the Decision of the National People’s Congress on
Establishing and Improving the Legal System and Enforcement
Mechanisms for Safeguarding National Security in the Hong Kong
Special Administrative Region, for the purpose of:
• p
reventing, suppressing and imposing punishment for the
offences of secession, subversion, organisation and
perpetration of terrorist activities, and collusion with a
foreign country or with external elements to endanger
national security in relation to the Hong Kong Special
Administrative Region;
• m
aintaining prosperity and stability of the Hong Kong
Special Administrative Region; and
• p
rotecting the lawful rights and interests of the residents of
the Hong Kong Special Administrative Region.

Article 41 This Law and the laws of the Hong Kong Special
Administrative Region shall apply to procedural matters, including
those related to criminal investigation, prosecution, trial, and execution
of penalty, in respect of cases concerning offence endangering national
security over which the Region exercises jurisdiction.
No prosecution shall be instituted in respect of an offence
endangering national security without the written consent of the
Secretary for Justice. This provision shall not prejudice the arrest and
detention of a person who is suspected of having committed the
offence or the application for bail by the person in accordance with the
law.
Cases concerning offence endangering national security within
the jurisdiction of the Hong Kong Special Administrative Region shall
be tried on indictment.
The trial shall be conducted in an open court. When
circumstances arise such as the trial involving State secrets or public
order, all or part of the trial shall be closed to the media and the
public but the judgment shall be delivered in an open court.

Article 66 This Law shall come into force on the date of its
promulgation.
