Dear Mr. Meraay,

I have received the referenced correspondence relative to a notice of alleged


hazardous working conditions and/or violations within Thunder Valley Casino Resort
(TVCR). Your letter asks that I conduct an investigation in regard to the allegations and
provide you, in writing, any findings and actions taken or to be taken, if applicable.
Written response was requested by July 9, 2020. A copy of the notice was posted in an
area for all employees to review and provided to the TVCR Safety Committee. The
Certificate of Posting was signed and returned on July 2, 2020. Below you will find a
summary of the allegations, findings from the investigation, and any actions taken in
response to the allegations.

Allegation

1. Adequate PPE not being provided when dealers interact with the general
public.

Investigation and Findings

Formal investigations commenced on July 2, 2020 and findings are noted below.

Due to the COVID-19 Pandemic TVCR has implemented a Health and Safety Plan that
outlines the policy and procedures taken in each department to mitigate the amount of
exposure the Dealers have to Guests, airborne droplets, and other potential infectious
diseases. During my investigation I used the TVCR Health and Safety Plan as the
template for identifying any violations that would lead to increased exposure. In brief,
the Health and Safety Plan for Dealers is as follows:

- Dealers will receive training before working on:


o COVID -19 signs, symptoms, and how to protect yourself
o CDC recommendations on handwashing, social distancing, mask use,
proper glove use, how to clean and disinfect surfaces
o What to do if you are sick
- During this training Dealers are issued a TVCR cloth facemask that is required to
be worn on property
- Dealers are required to clean and sanitize multiple objects in their area when a
trigger event occurs (switching dealers etc.) for complete lists please see
attachment (1) under “Cleaning and Sanitation Protocols”
- Seated capacity for Guests has been reduced for social distancing
- Guests are required to sanitize their hands before playing
- The Guest area will be sanitized after the guest departs
- In addition, all TVCR Team Members are screened for temperature and must
attest via a badge swipe that they do not have any of the current COVID – 19
symptoms before working each day. See attachment (2)
- All Guests on property will be screened for temperature before entry and must
wear a face mask. Guests may remove their facemask only when they are eating,
drinking, or smoking

During my investigation I observed approximately 80 dealers, and 10 floor


supervisors working on multiple days. All Dealers and Supervisors I observed were
wearing masks, making the Guests use the provided hand sanitizer, verbally tapping out,
cleaning the chairs, rails, and other objects in their area. Every table had a bottle of
hand sanitizer that contained at least 60% alcohol. See attachment (3). Every pit had a
bottle of sanitizer and disposable towels. The sanitizer used is non-hazardous and under
normal circumstances does not require any personal protective equipment to be used.
See attachment (4) for the SDS sheet. All guest observed in the Dealers areas were all
wearing masks, unless they were actively drinking or smoking.

Conclusion

During my Investigation all Dealers and Table Games personnel that I observed
were following all aspects of the TVCR Health and Safety Plan. This Plan is reviewed
frequently by all departments at Thunder Valley Casino for any issues, and if any issues
are identified, the plan is adapted. I could not identify any area where the Dealers were
violating this plan. In addition to the departmental review TVCR has a COVID-19
Monitoring Committee that includes TVCRs General Manager and Medical Professionals
who meet frequently to review any new cases of COVID-19 related illness in the
workplace, new information from the Local Public Health authorities, and to review any
changes needed in the TVCR Health and Safety Plan. TVCR is also committed to
conducting random COVID-19 screenings on property for our Team Members. These
screenings occur frequently on property and all results are reported to the Public Health
Department. A copy of this response will be provided to TVCR Safety Committee. Should

Table Games Operations

Cleaning and Sanitation Protocols


• Team Members will sanitize the exterior of the card shoe when entering the game and interior of the card shoe when the game is dead.
• Team Members will sanitize the toke box, discard holder, drop paddle, craps stick, and craps on/off button at dealer change.
• Team Members will frequently sanitize shufflers, shoe, pit podiums, pit stands, roulette non-value chips, laptops, Table Touch units, Kronos
units, TV control panels, baccarat keypads, Pai-Gow iVerify screens, phones, and stanchions.
• Team Members will sanitize signage after closing a table.
• Team Members will sanitize craps cubes before each guest handles the craps cubes.
• Team Members will change out cards as needed based on play per table.
Physical Distancing Protocol
• Reduced seating plan – Blackjack: 3 guest maximum per table. Big Baccarat: 4 guest maximum per table. Craps: 4 guests maximum on
each side. Roulette: 6 guests maximum per table.
• Dealers will verbally announce breaks instead of “tapping in”.
• Use of a poster sign holder with clear acrylic as a divider if requested (based on availability).
Guest Considerations
• Upon being seated, guests are required to sanitize their hands on all games.
• Guests and Team Members are required to wear protective masks.
• Team Members will sanitize the chair and rail after each guest departs and prior to seating when possible.
• Tableside dining is suspended.

Team Member Screening Attachment (2)

When a Team Member arrives for their scheduled shift, the following protocols will be adhered to for the foreseeable future:
• Each Team Member will have their temperature taken utilizing a non-contact infrared forehead thermometer.
• If the Team Member’s temperature is below 100.4 degrees (Fahrenheit), the Team Member will review a list of symptoms determined by the CDC that are
synonymous with COVID-19 on the monitor. If the Team Member’s temperature is below 100.4◦ F and is not experiencing any of the symptoms, the Team Member
will be asked to scan the bar code on their badge which will be the acknowledgement that the Team Member does not have any of the symptoms. At this time,
the Team Member will clock-in for their shift.
• The CDC COVID-19 symptoms that will be available on the screen are:
o Cough O Fever o Muscle pain o New loss of taste or smell
o Shortness of breath o Chills o Sore throat
• Should the Team Member stipulate that they are currently experiencing any of the symptoms reflected above, the Team Member will be precluded from
clocking-in (if hourly) or entering the building for their scheduled shift. The Team Member does not have to have a temperature that exceeds 100.4◦ F in
addition to one or more of the symptoms reflected above. Either or both will preclude the Team Member from clocking in for their scheduled shift.
• The Team Member will be asked to proceed to the Employment Center to meet privately with an EMT and/or medical designee.
• The Team Member will be asked which of the symptom(s) they are currently experiencing.
• The EMT and/or medical designee will attest to which of the symptoms the Team Member is experiencing by placing a check mark next to the symptoms on the
computer application. The Team Member will then review the information and scan their badge which will serve as the attestation that the information
checked is in fact accurate based on the information provided to the EMT/medical designee.
• The Team Member will then be asked to take a PCR test (nasal swab) if available. The swap will then be forwarded to the lab for diagnostic testing. The results
are expected no later than 48 hours after receipt at the lab. Upon receipt of the results, the Team Member will be contacted directly. The results are either
positive or negative. However, the employer can request a consent to release this information to a designated Human Resources representative.
• The results will be distributed through an online portal (used during the pre-registration) in which the Team Member will receive an email when their results are
complete.
• If the results are negative, the Team Member will return immediately upon their next scheduled shift.
• If the results are positive, the Team Member will be required to consult with their doctor and quarantine for the time deemed appropriate per the CDC
guidelines. Once the doctor provides a full-duty release, the Team Member will return immediately upon their next scheduled shift.
• The Team Member may opt out of having a nasal swap test performed. If this option is selected the Team Member will be asked to depart property and consult
with their physician.
• All test results will be sent to the County Public Health Department. 4
