Subject: Progress report of the work of KMF Project-reg. 

Sir,

You were awarded the Construction of Karnam Malleswari National Weight Lifting and Power Lifting
High Performance Training and Coaching center at Village Chahron, Yamuna Nagar, Haryana vide
agreement dated 28.03.2019 entered into pursuant to tender. 

The said Center would cater to the needs and aspiration of young sportsmen who want to excel and
bring pride to the nation and the said center would be their second home. 

As per the terms of the tender / agreement, the work awarded to you must be completed in stipulated
time i.e. at the end of March 2020. However,inspite of completing the work within stipulated time you
are making the excuses Bid later dated…

1 · Bid was submitted on 21/02/2019

2 · Letter of acceptance was issued by KMF on 13/03/2019.

· Performances guarantee amounting RS. 32, 27,620/- was
submitted on 26/03/2019 in accordance of the contract.

· Work order was issued on 26/03/2019 with contract value 5, 76,
36,075/- without GST. Being GST payable extra.

· Date of start commencing 15 days from letter of allotment i.e.
10/04/2019 with stipulated date of completion being 10/02/2020.

· Concrete design Mix was got approved from NABL approved lab
Omega test house on 04/04/2019 as per tender item.

· We wrote a letter on 01/04/2019 requesting structure as well as
architecture drawings.

· On 15/04/2019 again letter was submitted requesting the
drawings. It was also requested in letter to consider the date of
start only when required drawings are issued.

· On 28/04/19 again letter was mailed with CC to architect
regarding issue of drawings as the drawings for hostel block was
issued and in the drawings it was observed that the design mix is
given M30 instead of M25 item in tender.

· Design mix report was again has to be got done as per the new
item introduced in drawings i.e. is M30.

· As on 06/05/2019 meeting was held in New Delhi regarding the
work and we have been instructed to use M30 instead of tender
item M25 and we were instructed to submit M30 rate analysis as
extra item.

· Design mix as per M30 was issued by Omega test house on
11/05/2019.

· Rate analysis was submitted by us for M30 concrete on
23/05/2019.

· Meeting was held at site including architect on 02/06/2019. The
foundation work was started after getting the final nod from your
side on 10/06/2019.

· On 14/06/2019 final 28 days report was issued by Omega test
house regarding the M30 concrete.

· Routine testing used to be carried out at site besides testing from
a government lab in Jagadhari was being done for concrete cubes

· Later water and concrete cubes were sent from your side for
testing in NIT, Kurukshetra where all the reports were found
satisfactory.

18 · On 01/08/2019 we submitted letter to KMF regarding release of


payment of our 2nd RA bill.

· On 08/08/2019 we were abruptly asked to stop the work vide e
mail mentioning about test conducted by ShriRam test house for
which we were totally unaware about the sampling.

· We requested for elaborate and more decisive tests at site with
our presence and duly signed samples by both parties.

· Tests were conducted by ShriRam test house on 03/09/2019.
Hammer rebound test and core cut sample test were conducted
by the testing agency.

· Reports were released by ShriRam test house on 11/09/2019
which was provided to us on 13/09/2019.

· Again the reports were actually satisfactory but misread from your
side besides our plea that reports are within the parameters, we
were told that the samples are failed.

· The work was kept stalled from your side whereas our recurring
expenses were going down the drain.

· The architect was replaced by a new one for reasons beyond our
knowledge and the new architect started the redesigning the
project.

27 · Again in meeting held at site we were told on 29/09/2019 to


restart the work with minor repairs required at site.

28 · The concrete design mix was now again changed back to M25 and
worth mentioning that our rates of M30 were never approved
besides we did huge quantity of concreting.

29 · Again we resubmitted rate analysis of extra cement required as


per design mix report and sand filling required to be done in
hostel block as per the revised drawing of new architect on
4/12/2019.

30 · We were again misinformed about the water report whereas the


water report was OK given by NIT Kurukshetra dated 16/08/2020
and we were pressurized to install RO Filter where water was
good for construction .

· Besides our repeated requests our payments were not got
released from KMF at the same time we were told to expedite the
work.

32 · Our tender was allotted on acceptance letter from our side


mentioning GST extra shall be paid as applicable.

33 · Various reminders sent in November and December for balance


payment and approval of NS item along with issue of drawings.

34 · Revised bill was submitted on 06/1/2020 as per instructions with


concrete M25 instead of M30.

35 · Our bill was finally passed on 13/01/2020 amounting Rs. 1, 78,


31,555/- but payment was only released in bits and pieces.

36 · Work was resumed and we requested for drawings to carry along


the work.

37 · Plinth beam drawing of institute block was issued on 01/02/2020


and plinth beam work was started accordingly.
38 · Work of hostel block being carried out as per revised plan of
basement slab of hostel block issued on 15/02/2020.

39 · Basement roof slab of hostel building was casted on 17/03/2020


after various interruptions of intermittent rains.

40 · 5th RA bill was submitted on 18th march, 2020 amounting Rs. 73,


13,458/- payment still awaited.

41 · Columns of ground floor were started after casting of basement


roof slab design of ground floor roof slab is awaited till date.

42 · The institute block was also revised and revised drawings were
issued on 05/03/2020 with extension of block and other changes.

43 · The work was totally locked down due to Covid Pandemic.

44 · In our reply dated 28/03/2020 to your letter regarding renewal of


performance bank guarantee, we stated that understand that our
performance guarantee submitted in the shape of bank guarantee
expires on 31/03/2020. We requested you to kindly release our
payment of bill submitted on 18/03/2020 withholding the amount
of performance guarantee i.e. approx 32 Lacs and release our
bank guarantee submitted with you. We will re issue the
performance guarantee in the shape of FD duly pledged in your
favour, as soon as the work resumes after the lockdown and then
you may release our withheld amount of performance guarantee.

45 · The work was resumed after 20th April after the government guild


lines,with whatever labour left at site as a lot of labour left the site
due to panic of Covid Pandemic.

46 · Again the supply of raw material such as sand and aggregates


were unavailable upto 04/05/2020.

47 ·        Reminder prayers for pending payment were given on various


instances but no payment released till date.

 Respected Madame,

               Regarding the above said work we hereby wish to submit the date wise events or time line of
the project as under up till now:

     As evident with the timeline stated above and various situational issues and where the drawings were
being issued at plinth level on 01/02/2020 and basement roof slab on 15/02/2020 and other issues
stated the timely completion i.e. 10/02/2020, was practically impossible.

 We request you to extend the time limit of the project adequately at least upto 31/12/2020 as even
now, due to ongoing pandemic where labour are running away to their home state and the material
supply chains are very adversely affected the progress of works all over the nation are very badly hit and
there is situation of uncertainty. We shall spare no effort from our side to expedite the work with the
available resources and submit the revised bar chart/ completion schedule of the work as soon as the
situation normalizes occurred due to Covid pandemic.
We again pray to release our pending payment as we are in deep trouble and we are unable to carry on
the work in shortage of cash flow/funds. We have huge amount invested at your site in shape of
material lying at site along with our tools and plants and balance pending payments we request you to
do the needful at earliest please.
