Article 370: Abrogation & Reorganization

In an announcement with massive repercussions for Jammu and Kashmir, Home Minister Amit Shah
announced in Rajya Sabha that the government has repealed Article 370 of the Constitution which grants
special status to J&K. The government also decided to bifurcate the state into two Union territories –
Jammu and Kashmir, which will have a legislature, and Ladakh, which will be without a legislature.

ADVANTAGES
Right to education, which is a fundamental right, was not applicable to J&K.

Article 35A did not allow the thousands of Dalits who were brought in from Punjab as government
sweepers in 1957 to get any government jobs other than sweepers. They could not get a Scheduled Caste
certificate from the state government and therefore were not eligible for any benefits under central
government schemes.

J&K possess vast tourism potential in all its region. Due to terrorism and conflicts J&K could not utilize its
tourism potential to the full extent. By now with more integrity and uniformity, tourism would act like a
catalyst in the development of the backward regions.

Kashmiri Women to gain Most: So far Kashmiri women were deprived of their fundamental rights of
property. The abrogation of Article 370 will ensure that do not lose their rights on land and property even if
they get married to any Indian in any State

Anti-corruption agencies were not allowed in J&K due to article 370 (CAG). Also, Right to Information was
not implemented. So, J&K became the most corrupt state in India.

No Land or Property for Indians: Article 35A, which was abolished along with abrogation of Article 370, did
not allow any person from any other State of India to buy land or property in Kashmir. This was a major
drawback as no developmental work could take place and no substantial employment generation could be
seen.

DISADVANTAGES
The abrogation of Article 370 has not gone down well especially to elite Kashmiri political
leaders, separatists and terrorist groups. They are hell bent to flare up tensions in the valley.
This has caused security concern for common people.

It will take time before industry finds Kashmir a safe place to invest

The  passing of legislation as far-reaching as dismembering a State without prior


consultations  has set a new low.

CONCLUSION
It is to be seen now that after this alteration, the opposition will create a menace and even
some countries will play the terrorist hate crime technique. However, the government
should ensure a safer environment followed by equal dispersal of resources in these two
UTs. It also remains to be seen how the government with minimum external intrusion can
promise a better life to the citizens of the newly formed UTs.
