Your spouse works at a middle school and reports rumors of a teacher, Zane Wilkens, molesting
some students and taking illicit pictures of them. Zane allegedly viewed these pictures in his
office. Your spouse wants you to take a disk image of Zane’s computer and find out whether the
rumors are true. Write a one- to two-page paper outlining how you would tell your spouse and
school administrators to proceed. Also, explain why walking into Zane’s office to acquire a disk
image wouldn’t preserve the integrity of the evidence.

Answer:

 Firstly, there would first need to be a warrant to search Zane’s computer, or a monitoring
policy by the school.
 The school need to check their school policies on what they can do with an employee’s
workstation and what kind of monitoring can be done, and if there is no such policy, the
school need to create one as soon as possible.
 Once the policy is in place, the school could then monitor Zane’s workstation and look
for illegal activity. If there is evidence found, the next step, would be contacting law
enforcement.
 If the search and seizure is performed secretly by walking into Zane’s office and without
a warrant, any evidence obtained will not be valid or acceptable in court.
 The integrity of the evidence would be completely compromised because not only were
Zane’s rights violated, but the steps and procedures to ensure no evidence is tampered
with would not have been followed.
 Therefore, I would stress to my spouse and the school that all avenues of this issue
need to be followed exactly by the book, to ensure that if Zane is doing this illegal
activity, he is properly caught and there will be no mistakes in the investigation which
could mess up the case.
