AFFIDAVIT-COMPLAINT
I, MELANIE OBRIQUE-GUEVARRA, of legal age, married,
Filipino and resident of Block 10 Lot 1- C, Kawayan St. Manuela IV-H,
Pamplona Tres, Las Pinas City, under oath, hereby depose and say,
that:

1. I am a practicing lawyer of the Cos Guevarra and Associates

Law Offices with office address at Unit 201 Dona Eusebia
Rodriguez Bldg. 0611 Quirino Avenue, Paranaque City. I hereby
formally charge the following persons for violation of Section 4
(c)(4) of R.A. No. 10175, also known as the Cybercrime
Prevention Act of 2012 and Grave Threats as defined under
Article 282 of the Revised Penal Code;

1.1. MARYJANE L. DAGOHOY, with postal address at

Pizzaro, Lorton Bldg. Jalandoni Street, Iloilo City;

1.2. CHERRY LYN S. DACASIN, with postal address at

302 San Leonardo St., San Antonio Valley 1, Parañaque City;

1.3. JENNY ANNE S. CHUA, with postal address at 325-B,

J.P. Rizal St., Marikina City;

1.4. JESILLA GUANTIA aka JZHYLLE AITNAUG, with

postal address at Brgy. Habana, Buruanga, Aklan;

1.5. GERTRUDES P. BILLIONES aka SABEL KULOT

BILLONES, with postal address at Brgy. Habana, Buruanga,
Aklan;

1.6. ANNIE LIZA LABINDAO YEBAN with postal address

at Poblacion, Buruanga, Aklan,

herein referred to as RESPONDENTS.

2. On April 29, 2020, I posted a video of the public speech of our

Municipal Mayor in Buruanga, Aklan with the caption “Speech
of Mayor Concepcion Labindao during SAP Distribution in
Poblacion, Buruanga, Aklan” on the Facebook page of
Buruanga residents known as “Buruanganon Kita”. Buruanga,
Aklan is my hometown or birthplace.

3. The aforementioned video speech, however, garnered different

opinions. Eventually, it was shared and became viral on another
facebook page because of the opinion of many readers that the
said Mayor gathered her constituents just to scold them in
violation of the no mass gathering rule of the COVID-19 Inter-
Agency Task Force for the Management of Emerging Infectious
Diseases.

4. But on April 30, 2020 or barely a day after I posted the said
video on Buruanganon Kita FB page, herein respondents, being
the political supporters of the said Mayor, with malicious intent
created conversation threads on their Facebook accounts and
made me their laughing stock and object of ridicule by
impeaching, defaming and attacking my state of mind,
competence, integrity, virtue, honesty and reputation as a
lawyer and as a private citizen of good standing in the
community, and for the further purpose of dishonoring,
injuring and exposing me to public hatred, contempt, insult and
calumny, made sure that the said malicious posts be published
on their Facebook accounts, the pertinent and relevant portions
of the said posts and comments written in mixed English,
Tagalog and Visayan, are quoted hereunder, to wit:

5. That I tried to endure that day respondents’ malicious posts and

comments against me thinking they would eventually fade. But
despite the absence of any provocation of personal attacks on
my part like what they were doing against me, respondents
continued to attack, humiliate, bully, made me object
of ridicule and became their laughing stock everyday

 from April 30, 2020 to May 5, 2020 on their respective
facebook accounts.

6. Few days after they started humiliating me, my family and

relatives sent me messages begging me to do something to stop
respondents because they already felt humiliated and deeply
bothered also by the false image that respondents painted of
me.

Attached is the Affidavit of Ariel Chavez and hereto marked as

ANNEX “D”.

7. Thus, I sent respondents a message to stop from maligning me

otherwise they could be liable for cyberlibel. This made me
realize, however, that respondents were really out to destroy me
because instead of ceasing from posting malicious imputations
against me, they even attacked me more and questioned if how
could I be able to file a case against them when it was still ECQ.
The pertinent portions of the aforesaid malicious posts after I
asked them to stop posting malicious imputations are quoted
hereunder:

8. Verily, respondents’ malicious imputations against me were

posted daily by creating conversation threads on their FB
accounts, which lasted for six (6) days from April 30, 2020 to
May 5, 2020, which when read in its entirety, had for its object
to appear and made it understood, as was in effect understood
and interpreted by the public or persons who read the
comments, posts and conversations, that I am a lawyer who
is suffering from mental disorder and nervous
breakdown; that I am “Brenda”, “pulpol”, brainless,
“tanga”, “ang utak nasa talampakan”, “kailangan ng
total rehab”, dinidilaan ang bakas ng iba para
mabuhay, nangangapitbahay para maghagilap ng
makakain, unprofessional, incompetent, a pathetic
loser, my mind is affected by COVID 19, a lawyer who
has no client, a lawyer who always loses her case, a
lawyer who has no income, a lawyer who lives a sad life
and shames myself, a lawyer who does not know and
understand English, a lawyer who is not guided by my
professional organization and adulterous, among
others.

9. The pertinent and relevant portions of other malicious posts

and comments published by respondents on their FB accounts
are hereto attached as ANNEXES “F” and SERIES.

10 . That my son, Atty. Alexander O. Guevarra, Jr., who recently

took his oath as a new lawyer in June 2019, upon reading the
said malicious posts and comments, felt greatly affected, and
feared that he may also be judged, labeled and associated with
mental disorders by his clients. Friends and colleagues
especially that he was just building his career as a new lawyer.
He became very anxious and upset because he knew I was never
committed in any mental hospital to be called a lawyer with
mental disorder or may sira sa utak, pulpol and Brenda, among
others. I felt very sorry that my new lawyer son also went
through the public humiliation that I suffered every time he was
approached and messaged by different persons to comment
upon the malicious allegations against me on FB.

1. Moreover, respondent JESILLA GUANTIA amid their bullying

and defamation against me, messaged a certain Vener Prado
and accused me to be Prado’s girlfriend and a lawyer who is
“bastos”. Verily, this is a false imputation of a crime of adultery
as I am a married woman and Mr Prado is also a married man.
The message is hereunder quoted:

“indi gid tabimo matiis hay nga indi buligan imong nobya sa post nana…
hahaha may pagkabastos nga atty. Sobra pa sa wala it degree holder.”

(Transalation in Tagalog: Hindi ka talaga makatiis na hindi tulungan

ang iyong nobya sa post niya…hahaha may pagkabastos na atty. Sobra
pa sa walang degree holder.

FIRST ELEMENT: Discreditable act or condition concerning another.

10. Verily, the statements above-quoted disturb one's

sensibilities. Respondents’allegations ascribe to me the
possession of a vice or defect or portray me as a lawyer who is
suffering from mental disorder and nervous breakdown; there
is also an imputation against me as “Brenda”, brainless,
“pulpol”, “tanga”, “ang utak nasa talampakan”, “kailangan ng
total rehab”, dinidilaan ang bakas ng iba para mabuhay,
nangangapitbahay para maghagilap ng makakain,
unprofessional, incompetent, a pathetic loser, my mind is
affected by COVID 19, a lawyer who has no client, a lawyer who
always loses her case, a lawyer who has no income, a lawyer

 who lives a sad life and shames myself, a lawyer who does not
know and understand English, and a lawyer who is not guided
by my professional organization, among others. There is also an
evident imputation of a crime of adultery so that I will be
publicly embarrassed, vilified, hated, becomes the subject of
gossip, deprived of potential clients and to be suspected of
adultery.

12. The baseless, scurrilous attacks on my person did nothing

but damage my integrity and reputation as a lawyer and as a
person. In fact, the attacks undermined in no small measure the
faith and confidence of my clients in my professional service as
I started to receive calls and messages from clients, though
hesitantly touched upon the malicious posts maybe for fear of
offending me, I knew that those calls were meant for my
explanation on the matter.

SECOND ELEMENT: Publication of the charge

13. The element of publication is established in this case as

the malicious imputations were posted on respondents’
respective accounts when they created thread comments or
conversation to be seen by someone other than me against
whom it has been written.

 15. That respondent JESILLA GUANTIA deactivated her
facebook account before I was able to get her profile FB link but
attached is the profile of her FB account as ANNEX “H-5”.

THIRD ELEMENT: Identity of the person defamed

16. That I am the one referred to in their malicious posts

considering that during their public conversations on FB,
respondent Dacasin screened shot one of my Facebook posts
and posted it on her FB wall to inform her readers that their
posts and comments refer to me.

Attached is the printed screenshot of the respondent Dacasin’s

post and marked as ANNEX “I”.

18 . Respondent Jenny Anne Salmingo also clearly described me in

her comment (previously attached as Annex “F-12”) as someone
who did not stay in Buruanga Aklan and who is actually from
Kalibo Aklan; that my father was from Buruanga. The said
comment is hereunder quoted:

“Jenny Anne Salmingo

Mjane wa man magtinir sa buruanga ran. Sa kalibo kabay taran. Sa
huo dugo hay taga buruanga anang tatay. Maghambal ran kalibun hon
tana. Hay di nag English lamang 😂 😂 😂”

(Translation in Tagalog: Hindi naman nanatili yan sa Buruanga. Sa Kalibo

talaga yan. Oo sa dugo kasi taga Buruanga tatay nya. Magsalita yan ay
salita ng kalibo. Kaya nag English na lang sya. 😂 😂 😂)

19 . That it is clear in the above-quoted conversation threads that

they got upset because I posted the speech video of the
Municipal Mayor in Buruanga taken during the SAP
distribution; that the speech was made in public plaza by the
Mayor, hence, I believed that it was intended for the public to
hear. Yet, herein respondents did not like when I posted it
because according to them the video gathered some comments
NOT favorable to the Mayor. Hence, the bullying, harassment
and malicious imputations to destroy me so as to make the
public believe that I am suffering from mental disorder, among
others.

FOURTH ELEMENT: Evidence of malice

20 . The defamatory character of the imputations is shown by the

recitals thereof. The manner they posted or published the same
was with complete and reckless disregard of the fact that the
imputations are all false, hence, this clearly shows malice. As
can be gleaned from their recitals thereof, they were aware that
what they were imputing against me were all false. But they

 were out there motivated by ill-motive to destroy my reputation
especially to my kababayans in Aklan since we have more than
400 common friends and my clients are mostly from Aklan.

Attached is the FB profile account of respondent Mary Jane

Dagohoy to show that we have more than 400 common friends on
facebook and marked as ANNEX “J”.

21 . To further show their malicious intent in posting those

defamatory words against me, they even undermined the
integrity of criminal justice system by boasting publicly that
they could commit crimes these days because of ECQ, GCQ and
Covid 19, and that respondent Dacasin is not covered
jurisdiction wise by our so called law. The pertinent portion of
the post is hereunder requoted:

“Cherry Lynn Salmingo Dacasin

Jenny Anne Salmingo So anong grounds? Libel? Sino unang nagsabing
idiot? Ako ba? Oh dear I suggest review the constitution girl. I know that
the court don’t rely on assumptions and accusations should be factual
and accurate? Also being in the UK and the USA for that matter we are
not covered jurisdiction wise by your so called law! Think twice! Thrice
even! Napaghahalata, tsk tsk! 😂😂😂” (Previously marked as Annex
“F-11”).

FIFTH ELEMENT: Committed through a computer system

22 . Evidently, the libelous acts by respondents were committed

through a computer system as shown by the screen shots of
their facebook posts/comments as well as their respective
facebook profile links and accounts that they used.

23 . The libelous posts were published through their public FB

accounts or accounts accessible to and are made available to the
general public or are read by the said general public .

DAMAGES

24. Due to the said malicious public imputations by

respondents, I suffered and continue to suffer serious anxiety,
besmirched reputation, mental anguish, sleepless nights, not to
mention the negative impact on my occupation as a lawyer.
Based on human nature and experience, a rational client
would not choose to hire a lawyer who is suffering
from mental disorder, nervous breakdown and
brainless considering that the lawyers’ number one
asset is their brains.

 25. Due to such grossly injustice, malicious and libelous
imputations, I therefor pray that respondents be made to pay
jointly and severally, the damages I was made to suffer as a
result of the online published posts in whatever amount the
Honorable Court deems sufficient and proper together with the
attorney’s fees and the cost of this suit.

26. The law recognizes the value of such reputation and

imposes upon him who attacks it, by slanderous words or
libelous publication, the liability to make full compensation for
the damages done (Worcester vs. Ocampo, 22 Phil. 42).

27. I hereby execute this affidavit to attest to the truth of the

foregoing facts and hereby request the investigating prosecutor
to file the crime of Libel under R.A. 10175 against the herein
Respondents.
