MOTION FOR EXTENSION OF TIME TO FILE


PETITION FOR CERTIORARI UNDER RULE 64

Petitioner, by counsel, respectfully allege that:

1. On December 17, 2019, the Petitioner received a resolution issued on April


15, 2019 denying their Motion for Reconsideration issued by Commission
Proper (CP) en banc. A copy of the resolution is hereto attached as Annex
“A”.

2. Under Section 3 of Rule 64 of the Revised Rules of Court, time to file


petition. — The petition shall be filed within thirty (30) days from notice of
the judgment or final order or resolution sought to be reviewed. The filing
of a motion for new trial or reconsideration of said judgment or final order
or resolution, if allowed under the procedural rules of the Commission
concerned, shall interrupt the period herein fixed. If the motion is denied,
the aggrieved party may file the petition within the remaining period, but
which shall not be less than five (5) days in any event, reckoned from notice
of denial.

3. The last day to file the Petition for Certiorari under Rule 64 is on December
23m 2019 or not less than (5) five days reckoned from notice of denial.

4. That considering that the undersigned counsel’s services were just engaged
today, August 13, 2019, coupled with other equally important and urgent
professional commitments, the undersigned counsel cannot complete the
said Compliance on the show cause order dated June 18, 2019 issued by
this Honorable Court within the period required from the date of receipt of
the said Order by defendants-appellees, and will need an additional ten
(10) days from August 13, 2019 or until August 23, 2019 within which to do
so; 

5. This motion is being filed due to the reasons above-stated and not for the
purpose of delaying the instant case.  

         WHEREFORE, Petitioners pray that they be granted an additional five (5)


days from December 23, 2019 or until December 26, 2019 within which to submit
Petition for Certiorari under Rule 64.
