NON-DISCLOSURE AND CONFIDENTIALITY AGREEMENT

I, (Name of Investigator), (Position/Designation) of Division of ___________, by virtue of the

authority of the Regional Director is hereby designated as Fact-finding/Preliminary/ Formal
Investigator, Special Prosecutor of _____________ vs. __________ for (Offense/Violation). In
addition to the duties and responsibilities enunciated under DO 49, Series of 2006 and Magna
Carta Law for Teachers, acknowledges the importance of its legal obligation to protect the
information that he/she receives in the natural course of the investigation, and hereby binds to
the following non-disclosure policies:

1. I shall not give or provide any access to any information received or generated in the
course of her/his designation as Investigator to any unauthorized party;

2. I shall keep the evidences submitted in utmost confidentiality nor shall furnish, copies to
the parties or any person not privy to the case investigated;

3. I shall agree to preserve privacy whatever discussions, opinions, discoveries, theories

and conclusions in the aid of effective, and objective investigation;

4. I shall not relay, communicate, disseminate in any means whether text message, email,
phone call and other means of transmitting information of the outcome of the
Investigation Report;

5. I shall not use the confidential information for my own benefit nor give, review, dispose
and disclose to others or permit the use of others for their benefit to the detriment of the
proceedings, and the Department;

6. I will acknowledge accountability for my use and misuse of confidential information held
in trust and confidence;

7. I will accept liability of any breach of the non-disclosure agreement and understand the
consequences thereof. Moreso, I agree and am aware that my failure to fulfill any of the
provisions set forth in this agreement or any violation of the terms of the agreement, I
can be subjected to an appropriate Disciplinary/ Administrative sanction.
