BRIEF FACTS / INCIDENT :

z On 21.05.11, complainant Sh. Suresh Chowdhary r/o 746A,

Ward No. 6, Mehrauli, New Delhi visited PS Mehrauli and reported that
his 4 ½ years old son Abhishek is missing from his house since

dated 21-05-11 u/s 363 IPC PS Mehrauli was registered and
investigation taken up.
INVESTIGATION :

All out efforts were being made to trace the missing child and an
intensive search was made in the adjoining areas of Mehrauli. In the
morning of the fateful day, a procession of Ajmer Sharif had passed
through the market of Mehrauli and it was presumed that the child
would have been lost in the crowd and might go with the procession.
Hence, efforts were made to search the child throughout the way to
Ajmer Sharif but there was no clue about the missing child.

Keeping in view the gravity of the offence, a dedicated team

comprising Inspr. Dalip Kumar, Inspr. Rajiv Malik, SI Parveen Kumar,
SI Kailash, SI Shivdev Singh, SI S.P. Singh and ASI Ravi Shankar
Tyagi, 1055/D and HC Subhash, 83/SD was formed to locate the
missing child. During investigation, it observed that complainant and
his neighbour Shyam Babu Chowdhary have visited somewhere to find
out the child and hiding some valuable information from the police.

However, on regular persistence by team members, the

complainant informed that on 03-06-11, a letter regarding demand of
ransom of Rs. 5 lacs was found outside the house of his brother-in-law
for release of his child. On 24-06-11, another letter demanding ransom
Rs. 3 lacs was found by Shyam Babu Chowdhary on the road wherein
it was directed to send Shyam Babu Chowdhary on 26-06.11 at 4 pm
to Anand Vihar. On 26-06-11, complainant sent Shyam Babu
Chowdhary to Anand Vihar to negotiate with the kidnappers, who
came back and told that five persons in a vehicle met him and
snatched his mobile and a bag which he had taken with him and told
him that they would release the child after receiving the ransom
money. He also claimed that the child was shown to him and the
kidnappers also put a letter in his pocket wherein they directed that

Chowdhary kept on searching the child with the complainant. During
investigation, activities and conduct of Shyam Babu chowdhary were
found suspicious and he put on sustained interrogation.

thorough interrogation he did not conceded. The dedicated team
confronted him and interrogated with the sequence of events, which
he could not stand and finally switched over to different story to start
with the interrogation afresh. Though, it was very clear from his
conduct that he was not coming up with the truth and he took long
time to get extracted the truth from his mouth after a thorough and
tactful interrogation.

Finally, he broke down and admitted that he had kidnapped the

boy and killed him on the very same day i.e. 21/5/11 in the jungle
behind “Jamali-Kamali” by slitting his neck with a knife. He led the
police team to the spot of murder, deep in the forest and to get the
remnants of the body and other belongings of child recovered. The
body had passed the stage of decomposition, being old more than 40
days. At the instance of accused, a knife used in commission of crime
was also recovered. Accused further disclosed that he concocted the
story of kidnappers and wrote fake ransom letters to win the
confidence of complainants in order to extract the ransom money. He
further disclosed that he had already sent his family to his native
village in Nepal and was planning to escape to Nepal with the ransom
money, it he would have received the same from the father of the
child. He disclosed that earlier he had affection towards the child but
his father (complainant) used to scold him and told not to mix up with
his child. Hence, he planned to eliminate the child and extract huge
money from him.
