 Last date of Submission on or before a. July 24, 2020 (5:00 PM), b. Aug. 24, 2020
(5:00 PM) and c. Sept. 24, 2020 (5:00 PM)

 After submission of assignment viva-voce shall be conducted for 20 marks
 The candidates are required to specify in their submission –
Name, ID No., Semester and Subject.
 The students are required to submit their SACE in the trailing mail through which the
candidate has received the questions of SACE.

1. In a historic verdict, a seven-judge panel of the Supreme Court, in simple yet


significant words, said, “The relationship between man and God is an individual
choice. The State is forbidden to have allegiance to such an activity … Mixing State
with religion is not constitutionally permissible.” The staunch supporters of
secularism have often questioned the government’s religious subsidy policy as
interfering with the aforementioned personal relationship. In the light of the above
statement, critically analyse the following issues:
Is state expenditure of public money on religion justified in the light of Article 27? If
so, to what extent and who must set the limit?
Does the State funding of pilgrimages like Haj, Kailash Manasarovar and others,
violate Article 15(1)? Does the said Article read with Article 14 envisage maintaining
uniformity of discrimination?
How far does the protection guaranteed under Article 25 extend to acts done in
pursuance of religion? Should the ‘essential religious practice test’ be applied before
extending State prerogatives on the basis of religion?
What exactly is the true nature and objective of Indian secularism being part of the
basic structure of the Constitution?
What should be the scope and application of doctrine of liberal interpretation of
religious rights? (Marks 20)

2. A Kenyan legal scholar Joshua Maldizo Nyawa reminded us recently, Lord Atkin’s
legendary dictum – that “amidst the clash of arms, the laws are not silent”, which
applies as much to a public health crisis as it does to times of war or to Emergencies.
Write a critical essay analysing the impact of the steps taken by the government of
India to contain Covid – 19 on Part III of the Constitution. ( Marks 20)
