Prescribed Tender documents containing Terms and conditions can be downloaded from
the websites www.tmcassam.org which should be accompanied by the requisite Tender cost of
Rs.1000/- in the form of demand draft payable at Tezpur in favour of “The Member Secretary,
SMET,Tezpur Medical College & Hospital, Tezpur” payable at Tezpur
Sealed envelope containing the completed tender documents along with cost of tender
form and EMD superscribed as “SINGLE BID TENDER FOR THE SUPPLY OF
MEDICAL BOOKS AND JOURNALS ” should be dropped in the Tender Box kept in the
first floor of O/o Principal cum Chief Superintendent, Tezpur Medical College & Hospital,
Bihaguri, Tezpur upto 02.00 P.M on 25-09-2014. The Tender shall be opened on 25-09-2014 at
03.00 P.M at the conference hall of TMC & H, Bihaguri, Tezpur in the presence of the tenderers
or their authorized representative who may wish to be present. If the date of opening of tender
happens to be a holiday, the tender will be opened on the next working day. The Principal cum
Chief Superintendent, TMC & H, Bihaguri, Tezpur reserves the right to accept or reject all/ any
tenders without assigning any reason whatsoever.
1) TENDER VALIDITY
Tender shall remain open for acceptance for a period of 1 year from the date of opening of
Tender. Tenders received for shorter validity will be rejected.
b) Rates should be quoted in INR only. All payments will be made in INR only.
e) Bill in triplicate (pre-receipted) for the Medical books and Journals will be submitted by the
tenderer in the name of the Member Secretary SMET and Principal cum Chief Superintendent,
Tezpur Medical College & Hospital, Bihaguri, Tezpur for payment.
f) The bill should bear the certificate from the supplier that only Medical books and Journals of
latest edition have been supplied and the prices have been charged correctly and in
accordance with the latest publishers catalogue/invoice or importer/distributors
Invoice.
5) TERMS OF DELIVERY:-
All the Medical books and Journals should be delivered free of cost at the Central Library of
Tezpur Medical College & Hospital, Bihaguri, Tezpur, Sonitpur, Assam-784010.
6) DELIVERY PERIOD:-
a) The Medical books and Journals available in India should be supplied within 30 days and in
case of books imported from foreign publisher, the supplies should be completed within 45 days
from the date of Purchase order.
b) The delivery shall be through Registered/Book Post/Parcel/Courier/in person on
the risk and responsibility of the firm. No postage, Insurance or any other
charges whatsoever extra shall be paid.
c) Only original books will be accepted and no duplicate/defective/ photocopies of these shall be
entertained. If any such instance comes to the notice, the same shall be returned on risk and cost
of the firm.
d) The firm will supply Original Electronic CD of Books as received by them from
Publishers free of cost.
e) Books and Journals must be in good conditions. Mutilated, soiled books and journals if
supplied have to be replaced without charging any extra cost.
f) Letter of GOC must be submitted for conversion of rate Dollar, Euro, British Pound, etc., in
respect of foreign books and journals.
7) PENALTY CLAUSE:-
a. For delays:- If the supplier fails to supply the books as per purchase order within the time
period specified in the contract, the purchaser shall deduct from contract price/EMD a sum
equivalent to 0.5% of the price of delayed items for each week of delay or part thereof until
actual delivery up to a maximum of 10(ten) percent. Once the maximum is reached, the
purchaser may consider termination of the contract.
b. Termination of default:- The purchaser may, without prejudice to any other remedy or
breach of contract, by written notice of default sent to the supplier, terminate the contract in
whole or part if the supplier fails to deliver any or all publications ordered to him within the time
period specified in the contract, or if the supplier fails to perform other obligation(S) under the
contract. In the event of the termination of the contract by TMC & H, Bihaguri,Tezpur in
whole or in part, the TMC & H, Bihaguri, Tezpur may procure, upon such terms and in such
manner as it deems appropriate the undelivered Medical books and Journals and the supplier
shall be liable to pay for any excess cost for such purchases. However, the supplier shall continue
performance of the contract to the extent not terminated.
c. Force majeure:- The supplier shall not be liable for (a) and (b) above, if its delay in
performance or other failure to perform its obligations under the contract is the result of an event
of force majeure (Means an event beyond the control of the supplier and not involving the
supplier’s fault ornegligence and not foreseeable). Such events may include, but or not restricted
to, acts of the purchaser either in its sovereign or contractual capacity, wars or revolution, fires,
floods, epidemics, quarantine restrictions and freight embargo. The supplier shall promptly
notify the purchase of such conditions and the causes.
9) 0The Chairman Tender Committee reserves the right to accept or reject any tender or the
whole tendering process and reject any or all tenders at any time prior to award of the contract,
without thereby incurring any liability to the affected Bidders or Bidders or any obligations to
inform the affected Bidders of the grounds for the purchaser’s action.
11) In case of a dispute or difference arising between supplier and purchaser relating to any
matter arising out of or connected with the contract, such dispute or difference shall be referred
to the sole Arbitrator duly appointed by The Member Secretary SMET and Principal cum Chief
Superintendent, Tezpur Medical College & Hospital, Bihaguri, Tezpur. The award of the
arbitrator shall be binding to the parties concern.
