SERVICE CONTRACT

(Garbage Hauling and Disposal)

KNOW ALL MEN BY THE PRESENTS:

This Contract made and entered into by and among:

THE LAKESHORE HOMEOWNERS ASSOCIATION (Residential Enclave), Inc., a duly

organized corporation under laws of the Republic of the Philippines with office address at
Nueva Victoria Mexico, Pampanga and duly represented by its President, DR. CIRILO S.
BAUTISTA, hereinafter referred to as the “CLIENT;”

-and-

ROY B. GOMEZ & JAVIER C. HIZON, JR., both of legal age, Filipinos, and residents of
San Vicente and Parian, Mexico, Pampanga respectively, hereinafter referred to as the
“CONTRACTOR;”

WITNESSETH:

WHEREAS, CLIENT needs the services of a garbage contractor for the disposal of solid
waste materials from every existing households within The Lakeshore Subdivision
(approximately 150 households more or less) at Nueva Victoria, Mexico, Pamapanga,
hereinafter referred to the “PREMISES;”

NOW, THEREFORE, for and in consideration of the foregoing premises and of the terms
and conditions hereinafter set forth, the parties hereby agree as follows:

I. SCHEDULE AND SCOPE OF WORK

1. Garbage collection shall be scheduled as follows:

Two (2) times every week [Monday (a.m.) and Friday (a.m.)]

The contractor shall have the option to amend the schedule of the garbage
collection and disposal, provided that notice of the change is given to CLIENT at
least one (1) week before the scheduled pick-up date and the collections;

2. The hauling and disposal services shall cover all the existing households’ solid
waste material EXCLUDING Hazardous Waste and wet/liquid waste and grass
trims and tree trims;

II. CONTRACT RATE

1. For and in consideration of the full, faithful and complete performance of the
obligation, terms and conditions of this Contract by the CONTRACTOR, CLIENT
shall pay the CONTRACTOR, on a monthy basis, the amount of THIRTEEN
THOUSAND HUNDRED PESOS (PHP 13,000.00) net of taxes, upon
presentation of the Statement of Account by the CONTRACTOR at the end of
each month;

2. The CONTRACTOR shall submit to the CLIENT a Statement of Account on the

day last day of the month serviced;

3. Payment for services rendered shall be made within five (5) days from
submission of the Statement of Account.

III. TERM OF CONTRACT

This contract shall be effective for the period from January 1, 2019 to December 31,
2019.

 IV. OBLIGATIONS/WARRANTIES OF THE CONTRACTOR

1. The CONTRACTOR warrants that the vehicles and other equipments to be

used in the hauling and disposal of garbage are sufficient to meet the need of
the said service;

2. The CONTRACTOR warrants that the schedule of garbage collection shall be

followed religiously exept when, due to acts of force majeure or events not
attributable to the CONTRACTOR, the same can no longer be done, after due
diligence and exhaustion of alternative remedies. In this case, the
CONTRACTOR must notify the CLIENT through any means of communication
within three (3) hour of the happening of the event of its inability to performs
its obligation under this Contract;

3. The CONTRACTOR warrants that all its vehicles/personnel posses the

necessary valid licenses to drive the vehicles and/or haul garbage, and shall
confine themselves to the garbage collection work area;

4. The hauling shall be done as expeditiously as possible and in an orderly

manner, ensuring no littering within the PREMISES;

5. The CONTRACTOR shall see to it that its employees are properly identified
during the hauling operations;

6. The CONTRACTOR shall ensure the cleanliness of the PREMISES after the
hauling schedule;

7. The CONTACTOR further warrants that it has complied with all the laws and
regulations applicable to its garage collection operation and further warrants
that its waste disposal activity is in compliance with the sanitary and waste
disposal regulations of the government authorities.

V. OBLIGATIONS OF THE CLIENT

1. CLIENT shall be responsible for the segregation/separation of the SOLID

WASTE and that all waste should be placed on a proper and sturdy
bag/container;

2. CLIENT shall at all times practice the “ONE DUMP POLICY” and shall not allow
the other contractor to haul garbage other than the CONTRACTOR.

3. CLIENT shall provide only one (1) pick-up point/place for the Solid Waste to be
collected;
