Conceptual Analysis

1. Analyze the nature of restorative justice today and compare it with the traditional objective of
dispute resolution. Why does traditional dispute resolution appear to deviate from the ideas of
restorative justice? (Answer the question in 100 words. Essay format. 15 points?)

Restorative justice is to repair the relationship between the offenders and victims also the community
while the dispute resolution is to gives parties in dispute the opportunity to work through disputed
issues with the help of a neutral third party.
Dispute resolution deviate the idea of restorative justice because it preserves relationship by helping
people co-operate instead of creating one winner and one loser it focuses on the issues that are
important to the people in dispute instead of just their legal rights and obligations.
Dispute resolution is giving them an opportunity to tell their side and to remove conflict.

Conflict management promote the idea of restorative justice by compromising or avoiding.


Idea is that there is a settlement or punishment to repair the damage or to compensate the loss
of victim.
Also, to remove the conflict between the parties so that it will avoid the harm of each other’s.

Conflict transformation is aligned to the goal of restorative justice. The conflict should not be
regarded as an isolated event that can be resolved or managed, but as an integral part of
society’s on-going evolution and development.
For conflict transformation to occur, tensions between parties to the conflict must be
overcome first, by ensuring all actors recognize that their respective interests are not served
by resorting to violence and second, by seeking consensus on what should be transformed.
Conflict transformation is characterized by problem-solving to change or transform it into a
peace so that It will be settled between parties.
