CLASS OF INSURANCE : ELECTRONIC EQUIPMENT.

SUMMARY OF COVER: SECTION I: Material Damage

Against any unforeseen and sudden physical loss or damage to the


equipment and External Data from any causes not specifically excluded
by the Policy whilst working, at rest, being dismantled, or reassembling
for maintenance, movement or repair. (Including Burglary /Theft risks)

INSURED INTEREST:
All electronic equipment of every description and peripheral
equipment belonging to the Insured or for which the Insured is
responsible or has assumed responsibility to insure prior to
occurrence of damage/loss.

SECTION II: External Data Media- As per schedule

To indemnify the Insured against material damage to external


data media inclusive of information stored thereon.
Sum insured is the amount required for replacing lost or
damaged insured external data media by new material and
reproducing information or recompiling program (soft ware)
recorded or stored on data-carrying media, as more fully
described in the Policy wording.

SECTION III: Increased Costs of Working- N/A


If material damage indemnifiable under Section I gives rise to
total or partial interruption of operation of Electronic Data
Processing Equipment (EDP), Insurer will indemnify the Insured
for any additional expenditure necessarily and reasonably
incurred for; for hire of substitute EDP equipment, for personnel
expenses, costs of transportation of materials, express freight
and other incidental costs incurred to mitigate further loss or
keep in operation or production

BASIS OF VALUATION: Reinstatement/Full Replacement - If repairable to condition


substantially the same as it was, but not better or more
extensive than when new. If completely destroyed or damaged
replacement with new item of same kind, capacity, quality and
size.
MAJOR CONDITIONS:
1. Mechanical breakdown covered on condition that there is a
maintenance warranty or contract

CLASS OF INSURANCE: FIDELITY GUARANTEE

INSURER : BRITAM INSURANCE COMPANY (UGANDA) LTD

PERIOD OF: 12 MONTHS FROM INCEPTION.

COVER ON: Against loss of money or negotiable instruments or goods or


property belonging to the Insured or for which the Insured
is legally liable directly resulting from any act of fraud,
dishonesty and/or any infidelity of employees during
currency of this Policy.

acting in collusion.

PRINCIPAL
EXTENSIONS: i) Automatic reinstatement of Sum Insured –If the Insured
undertakes to pay additional premium at agreed rate on the
amount of loss calculated on prorata basis from date of loss
to expiry of current period of cover, it is agreed that in
event of loss, cover shall be maintained in force for full
aggregate sum insured, but only for other employees of
Insured not the suspect or culprit of fraud.
ii) Accountants’ Clause and Claims preparation costs.
iii) Costs of Recovery – In case of loss due to defined events
which exceeds the Sum Insured, the Insurer will in addition
to the Sum Insured pay to the Insured costs and expenses
up to stated limit necessarily incurred with consent of the
Insurer for the recovery or attempted recovery from the
employee in regard to whom the claim is made, of that part
of loss which exceeds the Sum Insured. Limit –Ushs.

any computer programme, system, data or software by any
insured employee who is employed in the insured’s
electronic data processing department or area
xi) Collusion Clause – (Limit Ushs 100,000,000– being a
multiple of the limit per employee depending on the
number of employees involved subject to aggregate limit
any one period of Insurance).
xii) Unidentifiable Employee – cover is afforded where the
employer can prove fraud or dishonesty by employees, but
cannot identify specific individuals. The onus is on Insured
to prove fraud or dishonest of employee and resultant loss.
xiii) Recoveries- Should the Insured incur any liability under this
Policy which exceeds the limit of Indemnity payable
hereunder, the Insured shall be entitled to all recoveries
(except from surety ship, Insurance, re-insurance, security
or indemnity taken or effected by the Insurer or for the
amount of any deductible) by whomsoever made on
account of such loss until fully re-imbursed, less the actual
cost of effecting the same, and any remainder shall be
applied to the re-imbursement of Insurer.
xiv) Cancellation Notice 30 days

GEOGRAPHICAL AREA: Uganda

DEFINITIONS: Occurrence shall mean – any defalcation or series of defalcations


committed by an employee or a number of employees acting in
collusion and discovered not later than 12 months after termination
of policy or not later than 12 months after termination of the
employment of the particular employee(s) is deemed to constitute
an occurrence and considered as one claim under the terms of the
Policy.

Collusion Clause- Any defalcation or series of defalcations


committed by 2 or more employees acting in collusion is deemed to
constitute an occurrence and considered as one claim in terms of
the policy, and in the event of such a claim arising the limit of
guarantee to be applied shall be deemed to be the aggregate of the
individual amounts guaranteed in respect of all the employees so
involved provided that the liability of the Insurer for such loss in
respect of any one employee shall not exceed the individual
amount guaranteed and in respect of all the employees implicated
in the loss, the amount of guarantee shall not exceed the maximum
guarantee as indicated on the policy schedule.

Fraud or Dishonesty – shall mean acts of default, larceny,


misappropriation, embezzlement, misrepresentation, deception,
forgery, invention, fabrication, false meaning, lying, breach of
promise or trust or of faith, among other infidelities

Insurers will pay any amount actually expended by the Insured in


producing and certifying any particulars or details required as
specified below, but limited to sum stated in the schedule:

a) In notifying Insurer and giving details of any other Insurance


covering the same event

required by Insurer), or loss of property and taking all practical
steps to discover the guilty party and recovering the stolen or lost

CLASS OF INSURANCE: MONEY

INSURER : BRITAM INSURANCE COMPANY (UGANDA) LIMITED

PERIOD: 12 MONTHS FROM INCEPTION

COVER: Loss of or damage to money (as defined) from any causes not
specifically excluded by the policy and occurring in Uganda.

INTEREST INSURED: Money deemed to include current coins, bank and currency
notes, travellers and other cheques, postal and money orders,
revenue and holiday pay stamps, script and share certificates,
customer’s credit cards, credit card slips and other certificates,
uncrossed and bearer cheques, insurance and current unused
postage stamp, treasury notes, and other documents or
instruments of a negotiable nature.

LIMITS OF COVER: 1. Transits with in Uganda- Ushs

the Insured which may be lost or stolen as a result of a hold-

 Skeleton keys Clause – Cover extends to loss or damage to
the property Insured caused or accompanied by entry to
receptacles by use of a skeleton key or other similar device
(excluding a duplicate key) provided that the Insured shall
establish to the satisfaction of the company that a skeleton
key or device was used.

GEOGRAPHICAL LIMIT: Uganda

LOCATION: All premises owned, rented, leased or hired by the Insured


anywhere in Uganda
BASIS OF VALUATION: Cash - Replacement.
Receptacle - Replacement.
Receptacle shall mean any safe, strong room, strong box, till,
cash register, cash box, or other receptacle for money or any
franking machine

EXCESS: 10% of claim amount, minimum Ushs. 200,000, 20% for cash in authorized
officers hands.

CONDITIONS:
 Subject to annual declarations of actual cash carryings done
the previous period of Insurance.
 Cancellation Notice 30 days
 Armed Guard warranty for amounts above Ushs. 50,000,000

MAJOR EXCLUSIONS: The following is a short form listing of major policy

a) War and related risks
b) Shortages due to clerical or accounting errors or omissions.
c) Loss from safes by use of original keys or duplicates
thereof unless such keys have been obtained by violence or
threats of violence.
d) Theft by or dishonesty of own employees not discovered
within 14 working days of the occurrence thereof.
e) In an unlocked safe or strong-room whilst the portion of the
premises containing such safe or strong room is unattended.
CLASS OF INSURANCE : COMBINED WORKERS COMPENSATION & GROUP PERSONAL
ACCIDENT

PERIOD OF COVER: 12 Months

COVER: Payment of benefits as defined, as a result of accidental death or


bodily injury caused by accidental violent external and visible
means to insured persons during the period of insurance.

EXTENSIONS: I) Riot, strike, civil commotion
ii) Burns disfigurement.
iii) Disappearance Clause – after 12 months
iv) Starvation, thirst and/or exposure to the elements
v) Motor cycling – up 750 cc
vi) Cover whilst under influence of prescribed drugs and/or
alcohol.(prescribed by Medical Practitioner) or
vii) Alcohol not exceeding the legal limit as per Ugandan laws
–80mg/100ml alcohol level in blood.
viii) Work-related sicknesses/illnesses including 54 scheduled
diseases
ix) Evacuation costs - 15,000,000/=
x) Artificial appliances –15,000,000/=
xi) Common Law Extension – Limit Ushs. 500M/= per
occurrence and in aggregate

g) While such insured person is traveling by air other than

h) As a result of one’s participation in any riot or civil
commotion.

COVER: Occurrence basis, however claims may be made any time after
expiry or cancellation of Policy subject to territorial limitation
laws, provided notification of possible claim was made as soon
as insured was aware of occurrence of defined event(s) during

TERRITORIAL

CONDITION:
No admission, offer, promise or payment shall be made by or on
behalf of the insured without the written consent of the Insurer;
the Insurer may take over and conduct in its name the defence
or settlement of any claim, or prosecute in its name for its own
benefit any claim for indemnity or damages. The Insurer shall
have discretion in the conduct of any proceedings and in
settlement of any claim, and the Insured shall give all such
information and assistance as the Insurer may require.

Claim Reporting Clause – In the event of non-renewal or


cancellation of the Policy either by the Insurer or by the Insured,
the Insurer will allow a time limit not exceeding the limitation
Period as per Ugandan Limitation Act from the date of expiry or
cancellation of the policy, for notification of claims which had
occurred during the Policy period, provided however, all claims
made during the extended reporting period shall be handled as if
they were made on the last day of the expiring Policy period and
are subject to the limits of indemnity and terms, conditions and
exceptions of the Policy.

PRINCIPAL
EXTENSIONS Policy is extended to include:-
 Additional Insured
 Fire and explosion
 Cross liabilities
 Emergency medical expenses –to indemnify the Insured for
all reasonable expenses incurred by Insured for such
immediate treatment as may be necessary at the time of an
accident causing injury to any person who may be the
subject of a claim for indemnity by the Insured.
 Tenants’ Liability – damage by defined events to premises
hired, leased, borrowed or rented by Insured is covered.
 Loading and unloading of vehicles.
 Medical first aid treatment.
 Food and drink poisoning.
 Car parks – Insurer will indemnify the Insured in respect of
liability due to defined event(s) causing damage to vehicle(s)
and/or their contents and accessories, the property of
tenants, customers, visitors, directors, partners, members or
employees of the Insured using parking facilities provided by
the Insured. Limit: Ushs 30,000,000 per occurrence Ushs
50,000,000 in the aggregate. (Cover includes theft of
vehicle contents )
 Movement of Vehicles –policy is extended to include liability
arising from or in connection with the movement of any
vehicle, trailer or caravan (not belonging to the Insured) by
any person being an employee or acting on Insured’s behalf,
provided such movement of motor vehicle, trailer or caravan
is undertaken to facilitate the carrying on of the insured’s
business.

 Wrongful arrest and defamation – the defined events are
extended to include damages:
a) Resulting from wrongful arrest (including assault in
connection with such wrongful arrest)
b) In respect of defamation
Provided always that the limits of indemnity as stated shall
not exceed -under each of a) and b) and in any one 12
months period of Insurance.

 Bailees Liability for Property in Insured’s care, custody,
control (if required)– To indemnify the Insured in respect of
all sums insured which the insured shall be required to pay in
respect of their legal liability as bailees of goods,
merchandise of every description and containers held and/or
stored by them in trust or on commission for which they may
be responsible to their clients and/or customers. Warranted
that the said goods, merchandise of every description and
containers shall be held and stored in the premises owned
and/or leased by the Insured. The Insurer shall not be liable
to make any payment under this extension in respect of
liability due to (i) wilful or illegal sale of property and/or
produce entrusted to the insured, (ii) loss caused by infidelity
of the employees of Insured or persons to whom property
and/or produce is entrusted, (iii) loss due to forged
warehouse receipts.

Security Firms – Notwithstanding anything to the contrary, if in


terms of contract with a security firm engaged to protect the
Insured’s property in the
course of the business of the Insured stated in the schedule or
persons, the insured becomes legally liable for the acts or
omissions of the employees of the security firm in the course of
their employment, then this section includes such legal liability
to the extent that indemnity would have been granted under
this section had the employees been under a contract of service
to the Insured and not to the
security firm, but not exceeding the limit of liability stated in the
schedule.
If, at the time of an event giving rise to a claim, the security firm
is entitled to indemnity under any other Policy in respect of the
same event, the Company shall not be liable to make any
payment except in respect of any amount above the amount
payable under such other policy.

Recoveries- Should the Insured incur any liability under this


Policy which exceeds the limit of Indemnity payable hereunder,
the Insured shall be entitled to all recoveries (except from
suretyship, Insurance, re-insurance, security or indemnity taken
or effected by the Insurer or for the amount of any deductible)
by whomsoever made on account of such loss until fully re-
imbursed, less the actual cost of effecting the same, and any
remainder shall be applied to the re-imbursement of Insurer.

DEFINITIONS: Injury – death of or bodily injury, illness disability or disease of or


to any person, including mental injury, anguish, shock, wrongful
arrest, detention, wrongful imprisonment, humiliation, post
traumatic stress, defamation or injury

Damage – loss of use of or damage to property; piracy,


plagiarism, passing off unfair competition or idea
misappropriation, infringement of design, patent copy right,
trade mark, service mark, trade name, title or slogan;
interference with servitude or other infringement of real or
personal rights
MAJOR
EXCLUSIONS: Cover provided excludes legal liability for claims in respect of:-
a. Injury to employees of the Insured (workers compensation).
b. Any vehicle which is required by law to by registered (motor
vehicle).
c. Property damage to property owned by the insured other
than premises leased or rented to the insured.
d. Punitive or exemplary damages.
e. Asbestos related incidents.
f. Liability in consequence of war, and related perils.
g. Liability arising form ionizing radiation or
contamination by radioactivity from any nuclear fuel or from
any nuclear waste.
h. Wrongful advice.
i. Products recall and/or guarantee.
j. Claims in respect of contamination or pollution unless caused
by a sudden, unintended and unexpected event
k. Damage to property on which Insured is or has been working
if such damage results from such work.
l. Goods or products sold or supplied
m. Damage caused by vibration or by the removal or weakening
of or interference with support to any land building or
structure.
Claim preparation Costs: Ushs. 5,000,000
Insurers will pay any amount actually expended by the Insured in
producing and certifying any particulars or details required as
specified below, but limited to sum stated in the schedule:

a) In notifying Insurer and giving details of any other Insurance


covering the same event
b) In informing the Police of any particular claim involving theft (if
required by Insurer), or loss of property and taking all practical
steps to discover the guilty party and recovering the stolen or
lost property
c) In providing Insurer with full particulars of claim and such
proofs, information, and sworn declarations as the Insurer may
require
d) In cooperation with Insurer, or their nominees, on behalf of
the Insurer in minimising the loss or damage.

COVER: ‘All Risks’ of physical loss and/or damage to the whole or part of the property
declared in the course of transit by the means of conveyance declared, including loading and
unloading risks.

Transit shall be deemed to commence from the time of moving the property described in the
schedule at consignor’s premises (including carrying to any conveyance and loading thereon),
continue with transportation to the consignee (including temporary storage not exceeding 14
days in the course of the journey) and end when off-loaded and delivered at any building or
place of storage at the consignee’s premises.
If any consignee shall refuse to accept property consigned, transit shall be deemed to continue
and the insurance in respect of such property shall continue in force, including incidental
storage, until the property is delivered at the premises of the consignor by any means of
conveyance, provided that the Insured shall take all reasonable steps to ensure that the
property is returned as soon as possible

DEFINITIONS: Defense Costs: Insurer will pay all costs, fees or expenses
incurred with their prior consent in investigation, defense
or settlement of any claim made against the Insured and
the costs of representation at proceedings in respect of
matters which have a direct relevance to any claim made
or which may be made against the Insured, provided such
claim or claims are the subject of indemnity. Such costs,
fees and expenses are called Defense Costs.

Claim Reporting Clause – In the event of non-renewal or cancellation


of the Policy either by the Insurer or by the Insured, the Insurer will

Claims Series Clause – For purpose of this policy where a series of


losses are attributable directly or indirectly to the same cause or error
or omission relating to discharge of professional services all such
losses shall be added together and shall be treated as one claim and
such claim shall be deemed to have occurred at the point in time
when the first of the claims occurred.

Waiver of Subrogation Rights against Employees – if any payment is


made under this policy in respect of any claim and the Insurer is
thereupon subrogated to all the Insured’s rights of recovery in relation
thereto, the insurer shall not exercise any such rights against any
employee of the Insured unless the claim has been brought about or
contributed to by the serious or willful misconduct of the employee.

Loss of documents- notwithstanding anything to the contrary, if


during the period specified in the schedule, the Insured shall discover
that any documents (as hereafter defined), the property of or
entrusted to the Insured or its predecessors in business, which may
now or hereafter be, or be supposed to be, in custody of the Insured,
or any other person to or with whom such documents have been
trusted, lodged or deposited by the Insured in the ordinary course of
business, have, while within the territorial limits specified in the
Policy, been destroyed or damaged, lost or mislaid and after diligent
search cannot be found, the Insurer will:
i) indemnify the Insured for legal liability as per policy limits
ii) costs and expenses of whatever nature incurred by the Insured
in replacing or restoring the documents
iii) costs and expenses incurred with the written consent of Insurer
in defense or settlement of any claim

Document – documents means deeds, wills, agreements, maps, plans,


records, books, letters, certificates, forms, documents whether
printed or reproduced by any other method other than bearer bonds,
coupons, bank notes, currency notes and negotiable instruments)

Queens’ Counsel Clause– The Insured shall not be required to contest


any legal proceedings unless a Queens Counsel (or lawyer to be
agreed upon by the insurer and Insured) shall advise that such
proceedings should be contested.

Dishonest or fraudulent act or omission shall mean an act or omission


on the part of any officer or employee of the Insured which was
committed with the manifest intent to cause a third party, to whom
the Insured may be held legally liable, to sustain a loss”

BASIS OF VALUATION: Market Value.

EXCESS:
a) 10% of each loss Min Ushs. 100,000
b) 15% Mini. Ushs. 100,000 for Theft & Total loss claims
c) Nil for Third Party Liabilities

CONDITION: No admission, offer, promise or payment shall be made by or on


behalf of the insured without the written consent of the Insurer
The Insurer may take over and conduct in its name the defence
or settlement of any claim, or prosecute in its name for its own
benefit any claim for indemnity or damages. The Insurer shall
have discretion in the conduct of any proceedings and in
settlement of any claim, and the Insured shall give all such
information and assistance as the Insurer may require.

USE: Social, domestic, pleasure and Insured’s business

DRIVERS: Any person authorized by the Insured and holding a


Valid Licence.
ROAD/DRIVING
LICENCE CLAUSE It is warranted that no claim shall be admissible (except so far as
necessary to requirement of the legislation) unless the driver
holds a valid driving permit, and class which is in force at the
material time the vehicle is involved in accident giving rise to a
claim and the vehicle is duly licensed to be on the road.

Provided that any driver shall be deemed to be licensed to drive


the vehicle if he is complying with the licensing laws relating to
the Policy geographical area, or non-compliance with any
licensing law is solely because of failure of renewal of any license
subject to periodic renewal, and if a license is not required by
law, or while such driver is learning to drive and is complying
with the laws relating to learners.
Provided the Insurer is not prejudiced as regards subrogation or
otherwise.
Claim preparation Costs: 2,000,000/=
Insurers will pay any amount actually expended by the Insured in
producing and certifying any particulars or details required as
specified below, but limited to sum stated in the schedule:

a) In notifying Insurer and giving details of any other Insurance


covering the same event
b) In informing the Police of any particular claim involving theft
(if required by Insurer), or loss of property and taking all
practical steps to discover the guilty party and recovering the
stolen or lost property
c) In providing Insurer with full particulars of claim and such
proofs, information, and sworn declarations as the Insurer
may require
d) In cooperation with Insurer, or their nominees, on behalf of
the Insurer in minimising the loss or damage.
MAJOR
EXCLUSIONS: The following is a short form listing of major policy exclusions:
a) War and related perils and terrorism
b) Theft by own employees
c) Loss of use (Consequential loss any kind)
d) Damage to tyres by braking, punctures, cuts,
or bursts.
e) Depreciation, wear, and tear, mechanical or
electrical breakages
f) Any driver with the general consent of the Insured who, to
the Insured’s knowledge is under the influence of
intoxicating liquor or drugs (unless administered by medical
personnel).
TYPE OF INSURANCE: POLITICAL VIOLENCE SABOTAGE AND TERRORISM:

PERIOD OF COVER: 12 MONTHS FROM INCEPTION


POLICY COVERAGE:
1. Sabotage:
Deliberate subversion that causes damage or destruction of
property.

2. Terrorism: Unlawful use of violence against


persons or property to further political
objectives.

3. Mutiny: Wilful resistance by members of legally


constituted, armed or peace keeping forces
acting in concert against superior officer(s).

4. Rebellion: Organized and open resistance by force of


arms, to all the laws or operation of a government,
committed by its citizens.

5. Coup d‟etat: Overthrow of an existing government by a


group of its citizens or subjects.

6. Insurrection: Violent rising of citizens of citizens or


subjects in resistance to their
government.
7. War and related risks
INTEREST: All property of the insured including all tangible and personal property of any description
whatsoever now or hereafter existing in any form including but not limited to buildings, contents,
stock, plant AND machinery and all as more fully described in the policy.

DEDUCTIBLE: Physical damage 10% minimum: USD 50,000.

CHOICE OF LAW AND JURISDICTION: Uganda

MAJOR CONDITIONS:

1. Statement of loss – Insured to file detailed, sworn statement of loss as soon as practicable.

2. Insured to take due diligence and take reasonable steps to minimize loss.

3. Insured to take reasonable measures not to disclose existence of the policy.

4. Insured to disclose any other policy covering same risks if any.

5. Insured to cooperate with insurer in matters relating to Insurance.

6. Insurer will not be liable for prolongation of interruption period due to delay in
repair of damaged property or procurement of spare parts caused by delay due to import/export
restrictions, customs regulations, currency or any other regulations imposed by government or
Public authority or unavailability of spare parts

7. Sum insured shall include invoice cost, freight, duties, taxes, erection or installation and all incidental
costs

CLASS: CONTRACTORS PLANT AND MACHINERY.

Period: (12 months)

Cover Summary: Cover against unforeseen and sudden physical loss of or damage to
the insured items, necessitating their repair or replacement. Cover
operates when plants are at work or rest, being dismantled for
purpose of cleaning, overhauling and reassembling
Cover also applies when equipment is being shifted from one point
to another at the same project.
