DID THEN AND THERE ENGAGE IN SUCH CONDUCT AS TO CONSTITUTE DISORDERLY CONDUCT ON
THE PRESENCE OF A LICENSE ESTABLISHMENT, TO-WIT: ATTEMPTED SO STRIKE RESTAURANT
STAFF AND BATTERED A PATRON WHICH CONSTITUTED A BREACH OF THE PEACE.
THE DEF APPROACHED A TABLE AT THE RESTAURANT AND COMMITTED A BATTERY ON A MINOR.
THE DEF THEN WENT TO THE BAR AREA AND WAS ASKED TO HAVE A SEAT BY A STAFF MEMBER
DUE TO HIS LEVEL OF INTOXICATION AND SINCE HE WAS NOT WEARING SHOES. THE DEF
APPROACHED THE STAFF MEMBER IN A THREATENING MANNER AND ATTEMPTED TO STRIKE HIM
TWICE. RESTAURANT STAFF TOOK PHYSICAL CONTROL OF THE DEF AND WALKED HIM OUTSIDE,
HOLDING THE DEF TO THE GROUND WHILE WAITING FOR OFFICERS ARRIVAL. POST MIRANDA, THE
DEF INVOKED HIS RIGHT TO REMAIN SILENT.
Contrary to Florida Statute/Ordinance 509- 1 43 .

CUTCHER AGAINST THE WILL OF ANDREW MICHAEL CUTCHER, AND DID NOT CAUSE BODILY HARM.
THE DEF WALKED UP TO THE VICTIM AND ASKED IF HE WAS WEARING A FACE MASK. THE VICTIM
ANSWERED YES AND THE DEF TOLD HIM TO TAKE IT OFF. THE DEF ASKED THE VICTIM IF HE COULD
SHAKE HIS HAND AND WHEN THE VICTIM REFUSED, THE DEF GRABBED HIS HAND AGAINST THE
VICTIMS WILL AND HELD IT TIGHTLY. THE DEF CLOSED IN ON THE VICTIMS FACE AND SAID "YOU
NOW HAVE CORONAVIRUS". VICTIM STATED THE DEF WAS IN SUCH CLOSE PROXIMITY THAT SPIT
PARTICLES FROM THE DEF'S MOUTH LANDED IN HIS FACE. POST MIRANDA: THE DEF INVOKED HIS
RIGHT TO REMAIN SILENT. THE DEF HAS NO PRIOR BATTERY CONVICTIONS AND THE VICTIM IS A
MINOR. THE DEF SAID HE IS UNSURE IF HE HAS CORONAVIRUS AND HAS NEVER BEEN TESTED.
