S. SPIVA T-05-019 1/27/05 On December 22, 2004 I was assigned to contact James Clapp. #56204 who had a concern with “time off issues” in his area. Clapp works in the Technical Services Division at the Pinellas County Jail. I had a brief phone conversation with Clapp about his concerns. Clapp told me that he has been working at the communications trailer at the jail for approximately two (2) years and believes there is a problem with favoritism by his supervisor, Eliseo Santana, #51595. Clapp thinks that if he were to “screw up” he would be in trouble however, if certain others were to do the same thing, they would not be in trouble. Clapp could give me no examples of what he meant or any cases where this has occurred. Clapp was not comfortable giving me names over the phone and I advised him that I would be coming out to meet with him in the near future and we could discuss this situation in greater detail at that time. Prior to the conclusion of this conversation, I did instruct Clapp to review general Order 3-4 pertaining to Hostile Work Environment and Discrimination. I told him that upon completion of reading this General order if he felt that his situation fit the definitions outlined there, that he needed to contact me back immediately. Clapp stated he understood. This ended out conversation. On January 5, 2005, Sergeant Michael Armsheimer and I met with Clapp at the AID office at the PCJ. I asked Clapp if he had the opportunity to review Go 3-4 and he said yes. Clapp said that he was not involved in a situation as described in the Go. Clapp believes that the favoritism began over 18 months ago and involves people not completing form 30's when they do not work a full eight (8) hour shift, Santana does not enforce time off sheets for certain people. Clapp believes that some of the people who are being favored are: Arnold Niederhoffer #52693 Demos Doulou #54734 Alvin Longgood #53036 Bruce Mallon #54608 Tom Baumgartner #54741 Eliseo Santana #51595 Clapp could not provide any specific dates or times that any of these individuals did not work an eight (8) hour shift. In fact, Clapp had absolutely no proof of any wrong doings by any of the people listed above. The only other person that Clapp thought would have knowledge was Barbara Fox, #50397 and she is the clerk at the trailer. Fox completes the payroll forms and computer entries for Santana’s section. Tt should be noted that Santana has sent two (2) inquiries to AID on Fox in the last two (2) months. Clapp even stated to us that Santana and Fox do not get along. Clapp also admitted to having a very good relationship with Fox. Due to the fact that Clapp could furnish no dates, times, or specific data surrounding his allegation, this will be closed as an information report only. A copy will also be forwarded to Director Dan Wiggins, #50513 for his information.
