AN ORDINANCE AUTHORIZING AND GRANTING PUBLIC SERVICE INCENTIVE AWARD TO

ELECTED BARANGAY OFFICIALS AND BARANGAY IPMR WHO HAVE SERVED THREE
CONSECUTIVE TERMS IN THE CITY OF MALAYBALAY, BUKIDNON EFFECTIVE MAY 15,
2018 AND THE YEAR THEREAFTER.

WHEREAS, the benefits granted to Barangay Officials under the Local Government Code of
1991 are very minimal compared to the overwhelming tasks they have to perform under
existing laws particularly in the area of peace and order community relations, despite the
limited resources made available to them;

WHEREAS, Barangay Officials are the front liners in giving efficient and effective services to
their constituents and making their Barangays to have good governance and any other
excellent performance they would achieve.

WHEREAS, Section 458 (a) of the Local Government Code of 1991 provides that the
Sangguniang Panglungsod shall enact ordinances, approve resolutions and appropriate
funds for the general welfare of the city and its inhabitants pursuant to Section 16 of the
same Code;

WHEREAS, the Barangay Officials who have rendered service for three ( 3 ) consecutive
terms are hereby given gratuity in recognition of their services rendered to the the City in
addition to what is provided for under the law;

BE IT ORDAINED BY THE SANGGUNIANG BAYAN IN REGULAR SESSION THAT:

Section 1. All elected Barangay Officials including Barangay IP Mandatory Representative

who have served three
( 3 ) consecutive terms starting Year 2018 are hereby granted “PUBLIC SERVICE
INCENTIVE AWARD”

Section 2. Scope and Coverage. Recipients of the award shall be Barangay Officials including
Barangay IPMR who have completed three consecutive terms of office as Punong Barangay,
Barangay Kagwad and Barangay IPMR respectively. Coverage of the award with respect to
the terms of office shall commence in the term of office year 2018-2021 and subsequently
the terms of office thereafter as basis for the qualification of consecutive terms of office.

Only the Punong Barangay, Barangay Kagawad or Barangay IPMR who has not been
declared guilty by final judgment in any administrative or criminal case in relation to
his/her office wherein judgment includes the forfeiture of all benefits of his/her position or
by any government agency, quasi-judicial body or court of justice at any time during
his/her term of office shall be entitled to the benefits provided under this ordinance.

In case of death of legible Punong Barangay, Barangay Kagawad or Barangay IPMR,

he heirs will get the benefit.
Section 3. Public Service Incentive Award. Manner of awarding, there is hereby authorized
Public service Incentive Award to Barangay Elected Officials including Barangay IP
Mandatory Representative of the City with the following service achievements and
corresponding grants.

A. An incentive award shall be granted for having serve three (3) consecutive
elective terms of continuous service to the municipality of the following elective
officials;

Punong Barangay - P 100,000.00

Barangay Kagawad - P 50,000.00

Barangay IPMR - P 50,000.00

B. In addition to the foregoing, a plaque of appreciation shall be awarded to any

elected official/ who qualify for the three (3) terms service award herein
provided.

C. The cash and material herein provided shall be granted any occasion of the
Barangay or right after the end of term.

Section 4. In case where the highest ranking Barangay Kagawad shall succeed the position
of the Punong Barangay by virtue of operation of law under Title Two, Chapter 2 of the
Local Government Code of 1991 on Vacancies and Successions, on his/her (3 rd) term as
Barangay Kagawad, the latter shall receive the same plaque of appreciation and / or cash
award for the position he was last elected.

Section 5. Funding. The Barangay Government of the (46) Barangays of the City of
Malaybalay shall allocate funds for the Public Service Incentive Award.

Section 6. The Barangay Council shall submit to the office of the Mayor, thru the Liga ng
mga Barangay (LnB) Malaybalay Chapter, the list of qualified Barangay Officials entitled to
the benefits provided under this ordinance one (1) month after the assumption of office of
the newly elected barangay officials.

Section 7. Separability Clause.- If, for any reason or reasons, any part or provision of this
ordinance is held to be unconstitutional or invalid, other parts or provisions hereof which
are not affected thereby shall continue to be in full force and effect.

Section 8. Repealing Clause. – All ordinances, rules and regulations, or parts thereof, in
conflict with or inconsistent with the provisions of this ordinance are hereby repealed or
modified accordingly.

Section 9. Effectivity.- This Ordinance shall take effect after its approval.
