EXECUTIVE ORDER NO. ___
Series of 2019

RECONSTITUTING AND STRENGTHENING THE MEMBERSHIP OF


THE PROVINCIAL SCHOOL BOARD OF THE PROVINCE OF NEGROS
OCCIDENTAL AND OTHER PURPOSES

WHEREAS, Section 98 of the Republic Act 7160, otherwise known as the


Local Government Code of 1991, provides for the creation and composition of the
Local School Board in every province, city and municipality

WHEREAS, the Department of Education (DepEd) is implementing the


reforms geared towards improving education outcomes by building on the efforts
of the Schools First Initiatives (SFI) and is creating a basic education sector that is
capable of achieving the goal of Education for all (EFA).

WHEREAS, it is the vision of the Provincial Government of Negros


Occidental to promote and ensure that its children are living happily in secured,
empowered, globally-competitive and child-friendly communities.

WHEREAS, there is a need to expand the composition of the Provincial


School Board in order to strengthen it in facilitating the preparation of education
development plans, to provide directions, to coordinate, implement and accomplish
the goals, plans, projects and programs of the Provincial Government of Negros
Occidental which will ensure quality basic education for the benefit of Negrense
children.

NOW THEREFORE, premises considered, I, EUGENIO JOSE V.


LACSON, Governor of the Province of Negros Occidental, by virtue of the
powers vested in me by law, do hereby order the following:

SECTION 1. REORGANIZATION. – The “Provincial School Board” is


hereby reorganized with the composition and functions laid down in the
succeeding sections.

SECTION 2. COMPOSITION. – The Provincial School Board of Negros


Occidental shall be reorganized to be composed of the following:

SECTION 3. SECRETARIAT. - The Provincial Planning and


Development Office and /or the designated staff of the Provincial Administrator’s
office assisted by the designated staff of the DepEd, Division of Negros Occidental
shall serve as secretariat that will give administrative and technical support to the
Provincial School Board as well as act as the custodian of all official records and
documents.

SECTION 4. - The Provincial School Board shall perform the following


functions:
a. Determine, in accordance with the criteria set by the Department of
Education, the annual supplementary budgetary needs for the
operation and maintenance of the public schools within the
Province and the supplementary local cost of meeting and other
needs which shall be reflected in the annual school board budget
corresponding to its share in the proceeds to the special levy on
real property constituting the Special Education Fund and such
other sources of revenues that the Local Government Code and
other applicable laws and ordinances may provide;

b. Authorize the Provincial Treasurer to disburse funds from the


Special Education Fund pursuant to the budget prepared and in
accordance with the existing rules and regulations;

c. Serve as an advisory body to the Sangguniang Panlalawigan of the


Province of Negros Occidental on Educational matters such as but
not limited to, the necessity for and the uses of the local
appropriations for educational purposes;

d. Recommend changes in the names of public schools within the


territorial jurisdiction of the Province of Negros Occidental for
enactment by the Sangguniang concerned.

SECTION 5. MEETINGS & QUORUM - The Board shall regularly meet


at least once a month and/or as often as may be necessary upon the call of the
Chairman or Co-Chairman. A majority of all its members shall constitute a quorum
necessary for the conduct of its official business. As a rule, the undersigned
Chairman shall preside over the meetings of this Board.

SECTION 6. EFFECTIVITY AND REPEALING CLAUSE - This


Executive Order shall be effective immediately and shall repeal, amend or
supersede all executive orders which are inconsistent with the provisions hereof.
