(a) We have examined and have no reservations to the Bidding Documents,

178,852 Nos. of 120kN and 219,972 Nos. of 160kN Standard Disc Insulators
OR 23,325 Units of 120kN and 28,692 Units of 160kN Standard Long Rod
Insulators [Delete whichever is not applicable].”
(c) The total price of our Bid, excluding any discounts offered in item (d) below,

(e) Our bid shall be valid for the period of 120 days specified in ITB Sub-Clause
20.1, after the date fixed for the bid submission deadline in accordance with

(f) If our bid is accepted, we commit to obtain a performance security in
accordance with ITB Clause 44 and GCC Clause 17 for the due performance
of the Contract;
(g) We, including any subcontractors or suppliers for any part of the contract,
have nationality from eligible countries [insert the nationality of the Bidder,
including that of all parties that comprise the Bidder, if the Bidder is a JV, and the

(h) We have no conflict of interest in accordance with ITB Sub-Clause 4.2;
(i) Our firm, its affiliates or subsidiaries—including any subcontractors or
suppliers for any part of the contract—has not been declared ineligible by
the Bank, under the Purchaser’s country laws or official regulations, in
accordance with ITB Sub-Clause 4.3;
(j) *We are making this proposal with a stipulation that you will award us two
separate Contracts i.e. one Contract for supply of all the goods on CIF basis and
the other covering all other goods to be furnished from India and services to be
performed in India.
* We declare that we have studied the provision of Indian Income Tax Law and
the prices have been quoted accordingly.
* We confirm that no Indian Income Tax is payable on sale of goods in the
proposed first Contract. However, Indian Income Tax, if any, applicable on the
second Contract shall be to our account.
(k) ** We, the partners of the Joint Venture whose signatures are appended below,
shall be liable jointly and severally for the execution of the Contract(s), in the
event of award, in accordance with the terms of the Contract(s). The Lead Partner
of the Joint Venture and incharge for this bid is M/s ………………………. on

*** We, the Bidder/Supplier & our Licensor undertake to comply with the
requirements stipulated for the Licensor & Licensee in Section-III (Evaluation &
Qualification Criteria) of the Bidding Documents and shall be jointly and
severally bound and responsible for the successful performance of the Contract
in the event the Bid is accepted by the Purchaser resulting in a `Contract’.
Accordingly, a Joint Undertaking, as per the format given at Form.8, Section-IV
of the Bidding Forms, by the Licensor along with us, is enclosed with the bid.
(l) We have read the provisions of following clauses and confirm that the specified
stipulations of these clauses are acceptable to us:
- Performance Security (GCC Clause 17)
- Applicable Law (GCC Clause 9];
- Deemed Export [Note under 14.6(a) of ITB];
- Terms of Payment [GCC Clause 15];
- Taxes and Duties [GCC Clause 16];
- Warranty [GCC Clause 27];
- Force Majeure [GCC Clause 31]; and
- Limitation of Liability [GCC Clause 29]

Further we understand that deviation taken in any of the above clauses by
us shall make our bid non-responsive as per provision of bidding
documents and rejected by you.
