PART Ill: NARRATIVE SHERIFF'S OFFICE G& “GIQUERE ROBERT PHILIP DEFENDANT DIO THE FOLLOWING ACT(S) WHICH CONSTITUTE A VIOLATION OF THE LAW (ELEMENTS OF THE CRME | PROBABLE CAUSE STATEMENT) ‘On April 7, 2020 I recieved cybertip number 64002451 in reference to the possible uploading of child pomography to a suspect Gmail account. According to the report, a file was uploaded to the suspect Gmail account which was reported to contain a single image, believed to be child pornography. This report was made to the National Center for Missing and Exploited Children by Google. Upon receipt of the cybertip, further investigation identified Suspect Robert Philip Giguere, W/M DOB 04/04/1954, and having an address of 4105 Lakewood Bivd, Naples, Florida, Collier County. On April 22, 2020 at approximately 1010 hours, myself and Det. Sgt. Williams #2759 attempted contact with the subject at 4105 Lakewood Bivd, and was advised that the subject was not there at the time. On April 23, 2020 at approximately 0920 hours, myself and Det. Sgt. Williams #2759 made contact with subject Robert Giguere at 4105 Lakewood Bivd who identified himself by his Florida Driver's License of G260-778-64-124-0. Upon contact, the subject did freely wish to speak with detectives and requested that we have a seat on a patio just outside of the residence. This contact was recorded without the subject's knowledge using a CCSO issued digital record Upon contact with the subject, he was asked if he currently had a Google Gmail account. The subject stated that he did and that it was previously shut down by Google approximately two month ago, further stating that he assumed that's ‘why he was being contacted. The subject was then advised that we had received a cybertip from the National Center for Missing and Exploited Children involving the possible upload of child pornography from his Gmail account which he identified as being RKGiguere2@gmail.com. The subject then stated that he does recall the particular image that was downloaded and stated that he often visits a ‘website called Chatropolis, which he described as a chatting site used to chat with a variety of other subjects about ‘Sexual fetishes and fantasies. He further stated that people often share sexual images, including child pomography in which you can download and save. ‘The subject further stated that he frequently visits the chatting si Chat rooms with other subjects. He stated that he often identifies himself as “BiMWM" which he identified. He stated that while his main focus was typically “men in panties” he stated that he has had chats involving the "fantasy, role- playing” acts including children and has downloaded other pictures depicting child pornography. as being Bi-Sexual, Married, White Male. ind often leaves the main site to chat within private ‘The subject stated that while on the website, he would usually use his laptop computer which he stated "broke" approximately two months ago during the same time of his account being shut down. He stated that his cellphone had also broken and that he had to get a new one. The subject did however produce his laptop which was found to have a broken comer. The subject further consented by signing a CCSO issued Consent to Search form for the forensic download of his laptop computer, identified as a Toshiba Satellite, 16 inch laptop, Serial # 8D103173Q. The laptop was Properly documented on a CCSO Property Receipt and a copy was provided to the subject. Upon retrieving the laptop, the subject stated that he was not certain as to what a “forensic download” meant, and ‘asked for clarification. At that time, the subject stated that there would be other child pornography on the laptop and possible evidence of his chats which included “role-playing” about the involvement of children in sexual acts. On April 28, 2020 a search warrant request for the forensic download of the subject's Toshiba laptop was completed ‘and forwarded to the SAO for review. The search warrant was granted on May 4, 2020 by the Honorable Judge Nicola and property served, at which time the forensic download was completed. ‘On August 12, 2020 | received the forensic report from the suspect's laptop and at that time reviewed its contents. Upon review of the forensic report, it was found that within the laptop's data files there were over 100 files which | personally viewed and determined the files to contain images of child pornography. All of the files were found to contain imahes of either, nude children while posing in a lewd manner, images of children engaging in sexual acts with other children, or images of adults engaging in sexual acts with children. The children depicted within the images appeared to range in approximate ages of two years of age to thirteen years of age. Based on the findings of this investigation, on August 12, 2020 at approximately 1548 hours, contact was made with ‘Suspect Robert Philip Giguere at his residence located at 4105 Lakewood Bivd, Naples, Florida. The Suspect was at that time placed under arrest and charged with 100 counts of Possession of Child Pornography, F.S. 827.071-5 and 1 count of Possesion of Child Pornography with Intent to Promote, F.S. 827.071-4.
