1. That the above case is pending for disposal before this Hon’ble court and fixed for
2. That considering the averments made by the respondent in her written statement, this
Hon’ble court has been pleased to pass an order dt. 27.07.2015 thereby directing the
respondent to deposit the arrears of rent w.e.f. December 2014 till date within thirty days
@ Rs. 500/- per month and also directed to continue to pay at the same rate month by
3. That the order passed by this Hon’ble court dt. 27.07.2015 was not complied with by the
respondent despite having been elapsed 65 days after the statutory period of 30 days. On
29.10.2015, this Hon’ble court on oral submissions of the respondent granted time in
terms of the section 15(7) of the DRC act to pay arrears of rent of the demised premises
in court to the petitioners. Thereafter, a sum of Rs. 5000/- was paid in the court which
was duly accepted & acknowledged by the petitioners from December 2014 to September
2015.
4. That respondent has again defaulted in payment of rent for three consecutive months i.e.
October 2015, November 2015 and December 2015 in terms of the order dt. 27.07.2015.
Therefore, at this stage the default created by the respondent is not at all excusable. Thus,
petitioners are entitled to an eviction order. Hence, the present application is filed.
5. That the present application is being filed in view of the facts and circumstances of the
case not otherwise. Therefore, petitioners are entitled for an eviction order at this stage.
6. That there is no undue delay in approaching this Hon’ble court by way of the present
PRAYER
It is therefore most respectfully prayed that this Hon’ble court may be pleased to pass an eviction
order of property no. 30/8 E, Hari om Gali, Babarpur, Shahdara, Delhi-32, most particularly
shown in the site plan filed by the petitioners, in favour of the petitioners and against the
respondent in the interest of justice.

conversant with the facts and circumstances of the case as such I am competent to swear

for an eviction order are true and correct to my knowledge and belief.
