Amendment IV.
The right of the people (you and I) to be
secure in their persons, houses, papers, and
effects (computer, cell phone, bank accounts,
DNA, etc.), against unreasonable searches
and seizures, shall not be violated, and no
Warrants shall issue, but upon probable
cause, supported by Oath or affirmation
(swearing out a warrant), and particularly
describing the place to be searched, and the
persons or things to be seized.
Government data basing (Data Mining)
• Operating between 1967 and 1973, over 5,925 foreigners and 1,690 organizations and
US citizens were included on the Project MINARET watch lists (among whom Malcolm X,
Jane Fonda, Joan Baez, Martin Luther King, etc.), a sister project to Project SHAMROCK.

• The Foreign Intelligence Surveillance Act of 1978 was voted by the Congress after the
exposure of the latter. The United States Foreign Intelligence Surveillance Court (FISC) is
a U.S. federal court authorized under 50 U.S.C. § 1803.

• In the United States, the DNA Identification Act of 1994 formally authorized the FBI to
operate CODIS (Combined DNA Index System). It was completed by the DNA Analysis
Backlog Elimination Act of 2000, which was amended by the USA PATRIOT Act, Title V.

• Homeless Management Information Systems developed in the late 1990s.

• CM/ECF (Case Management Electronic Case Filing)

• The FBI is currently the subject of a lawsuit brought by the Electronic Frontier
Foundation (EFF) because of a lack of public notice describing their database and the
criteria for including personal information, as required by the Privacy Act of 1974. The
lawsuits are a result of two Freedom of Information Act requests filed by the EFF in 2006.
• In 2006 the existence of the NSA call database was revealed. It is estimated that the
database contains over 1.9 trillion call-detail records. Project Stellar Wind efforts began
approximately seven months before the September 11, 2001 attacks.

• Fusion center was started as a joint project between the Department of Homeland
Security and the US Department of Justice's Office of Justice Programs between 2003
and 2007.

• The United States Air Force created, after the September 11, 2001 attacks, a
controversial database, TALON (Threat and Local Observation Notice) included lists of
anti-war groups and people who have attended anti-war rallies.

• In August 2007, the US Department of Defense announced that Guardian, another


database organized by the FBI, would take over data collection and reporting which
was previously handled by the TALON database system.

Anti-Immigration Extremism (U//FOUO) A movement
of groups or individuals who are vehemently opposed
to illegal immigration, particularly along the U.S.
southwest border with Mexico, and who have been

extremist goals.
They are highly critical of the U.S. Government’s
response to illegal immigration and oppose
government programs that are designed to extend
“rights” to illegal aliens, such as issuing driver’s
licenses or national identification cards and providing
in-state tuition, medical benefits, or public education.

Direct Action (U//FOUO) Lawful or unlawful acts of


civil disobedience ranging from protests to property
destruction or acts of violence. This term is most
often used by single-issue or anarchist extremists to
describe their activities.

The Alaska National Guard, in coordination with
nearly 50 organizations and more than 4,000
participants, conducted their state’s portion of
the annual Vigilant Guard exercise from April 26
-- May 1, 2010. Local governments, the State of
Alaska, Alaska National Guard and Joint Task
Force Alaska conducted a state-wide
exercise that was designed to “increase
emergency response capabilities” to
earthquakes and natural disasters. The exercise
scenario involved an earthquake affecting South
Central Alaska and combined the state’s Alaska
Shield exercise, National Guard’s Vigilant Guard
exercise, and Joint Task Force Alaska’s Arctic
Edge exercise. A major component of the
exercise involved the expertise of the National
Guard CBRNE Enhanced Response Force
Package, which deals with chemical, biological,
and radiological disaster response. The National
Guard describes the importance of the exercise
in building “synchronization” between local and
federal authorities.

From September 15-18, the Montana
National Guard will be performing a joint
exercise with FEMA and NORTHCOM to
help coordinate emergency response to
natural and manmade disasters. The
exercise is one of many regional Vigilant
Guard exercises being held by the

National Guard finished its Vigilant Guard
exercise in March and another round of
exercises in Iowa ended in June. These
Vigilant Guard exercises are part of a
larger, national-level program called
Ardent Sentry 2009. Ardent Sentry is

and its major “venues” include not only
the Vigilant Guard exercises, but an
“AMALGAM DART exercise involving air
defense activities at Camp Rilea, Oregon”
and “a Nuclear Weapons Incident
exercise (NUWAIX) with a U.S. Air Force
response near Cheyenne, Wyoming.”

Question: What tasks will DoD perform in a pandemic
influenza outbreak within the U.S.?

Answer: DoD has identified 19 critical tasks that the


Department will perform to provide protection for its
personnel, mission assurance, and support to civil
authorities, both foreign and domestic, in response to
a pandemic influenza outbreak. These tasks are
already driving the shape and content of joint training,
military exercises, and coordination with interagency
partners. These tasks include:
• Medical intelligence.

National Guard Domestic Law Enforcement and Mission Assurance
Capabilities
7-1. State National Guard Reaction Force (NGRF)
a. Overview. Formed from current units and personnel resources, the
NGRFs are designed to be rapidly deployable battalion-sized “all-
hazards” temporary task forces. They are capable of supporting law
enforcement by providing site security, presence patrols, show of
force, establish roadblocks and/or checkpoints, control civil
disturbances, provide force protection and security for Weapons of
Mass Destruction-Civil Support Team (WMDCST) or Chemical,
Biological, Radiological, Nuclear and high-yield Explosives (CBRNE)
enhanced response force package (CERFP) operations, or respond to
and assist in protecting selected assets.

Force protection -preventive measures taken to mitigate


hostile actions in specific areas or against a specific populous,
usually Department of Defense personnel (including, but not
limited to, family members and chaplains), resources, facilities,
and critical information.

The U.S. Army War College in November
released a white paper called Known
Unknowns: Unconventional ‘Strategic
Shocks’ in Defense Strategy Development.
The report warned that the military must
be prepared for a “violent, strategic
dislocation inside the United States,”
which could be provoked by “unforeseen
economic collapse,” “purposeful
domestic resistance,” “pervasive public
health emergencies” or “loss of
functioning political and legal order.” The
“widespread civil violence,” the
document said, “would force the defense
establishment to reorient priorities in
extremis to defend basic domestic order
and human security.”

In extremis; Latin phrase meaning "in the


farthest reaches" or "at the point of death“.
Final thoughts;

• World history has shown the unprecedented expansion of Government, leads


to the encroachment upon civil and individual liberties.

• Any deployment of troops (or rumors thereof) to the field (CONUS) or the
militarization and federalization of state and local police forces give citizens cause
for pause.

• When the citizens have lost faith in their Government, they no longer believe
Government is working in the peoples best interest.
What I hope you take away;

• There is hope. But “We the People” have to, and can change our Government.

• Peaceful revolution will be at the ballot box.
