DEED OF EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Extrajudicial Settlement of Estate with Deed of Absolute Sale


is executed by and between:

ROSITA A. MALLARI, of legal age, widow, Filipino citizen and a


resident of Mabilog, Concepcion, Tarlac;

SANDRA MALLARI VILLANUEVA, of legal age, married, Filipino


citizen and a resident of Mabilog, Concepcion, Tarlac;

GERRY A. MALLARI, of legal age, married, Filipino citizen and a


resident of Mabilog, Concepcion, Tarlac;

JESSIE A. MALLARI, of legal age, Filipino citizen and a resident of


Mabilog, Concepcion, Tarlac;

JAYSON A. MALLARI, of legal age, Filipino citizen and a resident of


Mabilog, Concepcion, Tarlac;

LORNA MALLARI CRUZ, of legal age, married, Filipino citizen and a


resident of Mabilog, Concepcion, Tarlac;

JHOEMY A. MALLARI, of legal age, Filipino citizen and a resident of


Mabilog, Concepcion, Tarlac;

WITNESSETH:

That the above-named parties are the heirs of the late POLICARPIO M.
MALLARI who died intestate on __________________, at
__________________________, a copy of his Certificates of Death are hereto-
attached for reference;

That the marriage between POLICARPIO M. MALLARI and ROSITA


A. MALLARI begot six (6) children namely: SANDRA MALLARI
VILLANUEVA, GERRY A. MALLARI, JESSIE A. MALLARI, JAYSON A.
MALLARI, LORNA MALLARI CRUZ, and JHOEMY A. MALLARI copies
of their Certificates of Live Birth are hereto-attached for reference, respectively;

That the late POLICARPIO M. MALLARI , at the time of his death left a
parcel of land situated in Barangay Mabilog, Concepcion, Tarlac, covered by
Transfer Certificate of Title No. CARP2013001924 with an area of SIX
THOUSAND SIX HUNDRED (6,600) square meters, more or less, particularly
described as follows:
TRANSFER CERTIFICATE OF TITLE NO. CARP2013001924
CERTIFICATE OF LAND OWNERSHIP AWARD NO. 01192299

“A parcel of land (Lot 1516 of the consolidation-subdivision


plan LRA PCS-39464 approved as a non-subdivision project, being a
portion of Lots 26 (road), 32, 33, (Canal), 34, 35, 36, (Canal), 41, 42,
(Railroad), 43, 44, 45, 46, 50, (Canal), 51, 52, (Canal), 53, 54, 55,
(Railroad), 56, 57, (Railroad), 58, 59, (Canal), 60, 63, (Canal), 64, 65,
66, 68, 69, 70, 71, 72, (Canal) 73, 74, 75, 76, 77, (Canal), 78, 79, 80,
(Canal), 81, 82, (Canal), 83, (Road), 84, 85, (Canal), 86, 87, 88,
(Road), 89 (Road), 90, 91, 92, 93, 94, 95, 96, all of PCS-03-038734,
Lots 37-A, 37-B, 37-C, 38-A, 38-B, 38-C, 47-A, 47-B, 47-C, 61-A,
61-B, 61-C, 39-B-1, 39-B-2, 39-B-3, all of NGS-03-000011-D, LRC
Rec. No. 2636), situated in the Barrio of Mabilog, Concepcion, Tarlac,
containing an area of SIX THOUSAND SIX HUNDRED (6,600)
square meters, more or less”

That to the best knowledge and information of the parties hereto, the said
deceased POLICARPIO M. MALLARI left no wills or debts;

That we, the parties hereto, being of legal age and with full civil capacity to
contract pursuant to Section 1 of Rules 74 of Court of the Philippines, hereby by
these presents agree to divide and adjudicate unto ourselves the estate of deceased
POLICARPIO M. MALLARI in equal shares;

DEED OF ABSOLUTE SALE

That, FURTHER, for and in consideration of the sum of

ROSITA A. MALLARI, (SELLERS) hereby SELL, CONVEY, and TRANSFER,
by way of Absolute Sale unto _______________________________, of legal age,
married to __________________________, Filipino citizen and a resident of
_____________________________, their heirs and assigns and successors-in-
interests, all of their rights, interest and participation over the parcel of land
covered by TCT No. CARP2013001924 of the Registry of Deeds Tarlac, free from
all liens and encumbrances.

That SELLERS hereby acknowledge receipt of the amount of
