MOTION TO DISMISS

COMES NOW, the undersigned Station Commander of the Integrated National Police
Dalupiri Island, Cagayan Province and unto this Honorable Court most respectfully moves for the
dismissal of the above entitled case on the following grounds to wit;

1. That the private complaining witness/offended party has manifested to the undersigned
his lose of interest in the further prosecution of the above entitled case as shown by his affidavit
of Desistance Marked as "Annex" A and made integral part of this motion;

2. That he further manifest had will no longer appear and testify in court against the
accused even if called to do so;

3. That in view of this change of event, that is on the part of the complaining witness and
considering that there are no other witnesses for the cause of the government for the present
time, the undersigned is of the considered belief that he could no longer prove the guilt of the
accused beyond reasonable doubt.

Wherefore, it is respectfully prayed of this Honorable Court that the case against the
accused be dismissed with cost de officio.
