ARCHITECT’S ACT

“An Act to provide for the registration of architects and for matters connected
therewith.”

 The Act provides for registration of Architects, standards of education,


recognized qualifications and standards of practice to be complied with
by the practicing architects.
 Piloo Mody was instrumental in in promoting the Architect’s Act,1972
 The Council of Architecture (COA) has been constituted by the
Government of India under the provisions of the Architects Act, 1972,
enacted by the Parliament of India, which came into force on 1st
September, 1972.
 The practice of a profession of a n architect is governed by the
Architect’s Professional Conduct Regulations,1989. An architect is
required to observe professional conduct as stipulated in the regulations
of 1989 and violation of which shall constitute a professional
misconduct, which will attract disciplinary action.

It consists of four Chapters and one schedule. The chapters in turn list 45
points.

The act primarily deals with


 ‘the use of the title “architect” ‘
 ‘Council of Architecture’ (COA)
 Qualification of registration

CHAPTER 1
Chapter 1 of the Architect’s Act,1972 consists of 2 sections, definitions of the
terms used and a short title/extent/commencement.

CHAPTER 2
Chapter 2 of the Architect’s Act,1972 consists of 20 sections, which provides
for the establishment of the Council of Architecture which is a body
corporate.

 The COA maintains a registrar of architects registered under the act.


 The COA has the power to revoke the registration of an architect if any
misconduct is reported.
 COA prescribes standards of professional conduct and etiquette and a
code of ethics for Architects.
 It has the power to make regulations.

The COA is charged with the responsibility to regulate the education and
practice of profession throughout India besides maintaining a register of
architects.
The Government of India has introduced the Architect’s Act primarily for the
creation of a regulating authority ie COA.
CHAPTER 3

Chapter 3 of the Architect’s Act,1972 consists of 12 sections, they deal with


the Registration of Architects.

 The register includes the particulars of the registered architect,


his/her qualification for registration and the authority that conferred
it.
 COA may remove the name from the register for misconduct or due
to other reasons.

CHAPTER 4

 Chapter 4 consists of nine miscellaneous sections that details


penalties for being falsely registered, prohibition against use of
titles etc.
 A person can not use the title of an architect unless he/she is
registered with the COA.
 A person falsely claiming to be an architect will be fined 1000
rupees
