1. The application is allowed subject to the applicant filing certified
copies of the documents relied upon alongwith the court fees/deficit court
fees, if any, within 72 hours from the date of resumption of the regular
functioning of this court.
2. The application is disposed of.

1. The present petition has been filed seeking following reliefs: -

“a) Issue an appropriate writ, order or direction


in the nature of Mandamus Writ Petition Under Articles
226 of the Constitution of India Seeking a Writ, Order
or Direction in the nature of Mandamus Directing the
Respondent No. 1,2,3 to ensure compliance with order
dated 21.04.2020 passed by Respondent No.1, order
dated 22.04.2020 passed by Respondent No. 2 by the

Respondent no. 4 qua non charging of container
detention charges or any other ancillary charges during
the lockdown period from 22.03.2020 to 03.05.2020 the
lockdown period in addition to the free days under the
contract.
b) Issue an appropriate writ, order or direction
directing the Respondent nos. 1,2,3 to initiate strict
action against Respondent no.4 for willfully disobeying
the orders passed by the Respondents.
c) Pass such other and further orders as this
Hon’ble Court may deem to be fit and proper under the
facts and circumstances of the present case.”

2. Issue notice.
3. Ms. Anjana Gosain, learned CGSC accepts notice on behalf of the
respondents No1. & 2 and informs the court that two similar matters i.e.
W.P.(C) 3171/2020 & W.P.(C) 3195/2020 are coming up for hearing before
the Roster Bench on 26.05.2020. It is further pointed out that the
Department of Customs, Ministry of Finance and the Central Board of
Indirect Taxes are also necessary parties to this case.
4. Mr. Akshat Bajpai, learned counsel for the petitioner seeks time to
take necessary steps to implead them as parties to this petition..
5. List this matter alongwith W.P.(C) 3171/2020 & W.P.(C) 3195/2020
on 26.05.2020 before the Roster Bench. In the meantime, learned counsel
for the petitioner shall ensure that all necessary parties are impleaded.
