SUBJECT: SEEKING ADVICE FROM THE LAW &
PARLIAMENTARY AFFAIRS DEPARTMENT PUNJAB ON THE REGULARIZATION OF DAILY WAGES EMPLOYEES OF PUNJAB HEALTH FOUNDATION. Please refer to the subject cited above. 2. Punjab Health Foundation is an autonomous body established under PHF Act, 1992 to promote and finance the development of the health sector in the Province of Punjab. That due to urgency and dire need of work force PHF appointed number of its employees against permanent seats on daily wages contract for 89 days. Some of the employees working since the inception of the Foundation filed a writ Petition bearing NO. 9309/2011, in Lahore High Court for the Regularization of their service, which was decided in favor of the petitioners on 06.01.2017. Aggrieved by the decision, Punjab Health Foundation filed a CPLA 793/2/2017 in August Supreme Court of Pakistan which is still pending for adjudication. During the time said employees filed a contempt petition in the Lahore High Court, the Court a Regularization of the petitioners as no injunctive order was passed in said CPLA which was obeyed in letter and spirit and regularization was granted to the employees subject to final outcome of CPLA. 3. Meanwhile another writ petition bearing NO. 121524/2017 was filed by some other employees working bon daily wages contract of 89 days for PHF. An order was passed by the Hon’abl Lahore High Court on 18.12.2017 directing the respondent/ Foundation to consider the writ petition as representation of the petitioners and to decide the same in six weeks. No order till date has been passed by the authorities of the PHF as the CPLA is still pending in the August Supreme Court of Pakistan in same type of matter. Now the contesting petitioner have filed a contempt petition in the Hon’abl High Court which is pending for adjudication. 4. Another writ petition bearing NO. 131319/2018 seeking the regularization of petitioners is also pending for adjudication in Lahore High Court in which no dictating order has still been passed. 5. Under the circumstances an advice is being seek from the Law & Parliamentary Affairs department to guide the future course of action for the writ petitions pending before the Honorable High Court, and regularization of the said employees. 6.
