TOPIC- CAN I TRANSFER MY LIQUOR LICENCE TO

SOMEONE ELSE???

Yes, licence can be transferred from one owner to another. You can transfer a
liquor licence when you buy or sell a business, or you want to change the
licensee. Usually Liquor & Gaming NSW will give you provisional approval
within 5 working days, so the business can continue operating. Confirmation of
the transfer will take about 60 days. If you have the necessary authorisation, you
can transfer online.

Eligibility
Applicants must be 18 years or older, and may be :

 the existing licensee


 the proposed licensee
 the premises owner
 the business owner
 secretary or other office-bearer (only for a limited liquor licence held on
behalf of a non-proprietary association)
 general manager of a council (only for a limited liquor licence held on
behalf of a non-proprietary association that is a public authority or
community association).

 Types of liquor license transfers:

o Person to person (or business to business) in the same location


o Place to place with the same person (or business)
o "Double transfers", where both the owner and location change

RULES
 First, check with your liquor agency (or attorney or someone who knows the
liquor license law in your jurisdiction) to see if your state allows the transfer of
liquor licenses. Most states do allow the buying and selling of liquor licenses
because they view liquor licenses as personal property of the owner – which legally
allows for the open trade of the license. Some states, however, require the owner of
the liquor license to return the license to the state once the owner is done with it.
Then, the state reissues the license to the next available recipient.
 So, if your state allows you to legally transfer the liquor license, make sure
the transfer occurs at the same physical location or locale. Remember, you cannot
generally transfer your license to a store/business outside of your liquor license
geographic location. That’s because liquor licenses are obtained and maintained
within geographical boundaries generally determined by population.

Rules for transferring Liquor shop licence in Maharashtra

The decision was taken after it was found that several license holders illegally transferred
their licenses at a hefty cost ranging from Rs 25 lakh to Rs 1.25 crore.

Excise Minister Chandrashekhar Bawankule on Tuesday said that the license


holder will not be able to transfer the license outside his family as per the new
rules to be drafted soon.

"The license is a government property. No one has a right to transfer it without


the government approval.

"He/she could be eligible to transfer the license to his/her legal heir only. Also,
we will not allow partnership in the liquor shops. If anyone does not want to run
the shop he/she will have to surrender the license to the government. We will
auction it to the highest bidder," he said.
He, however, made it clear that no action will be taken against those who have
already transferred their licenses outside the family. He also informed that the
government will soon come up with an offer for the country liquor shop owners
under which they would be able to upgrade their liquor shop.
