FACT:
Accused-appellants argued that the prosecution failed to prove the fact of delivery or
transport of the seized illegal drugs to another person or entity. They are in the position
that the act of passing on the dangerous drugs from one to the other must be
established and the mere presence of a dangerous drug inside the vehicle could not be
construed to mean that such item is intended for delivery.
ISSUE:
W/N mere presence of a dangerous drug inside the vehicle could not be construed to
mean that such item is intended for delivery.
RULING:
The mere commission of the act constitutes the offense and is sufficient to validly
charge and convict an individual committing the act, regardless of criminal intent.
Since the crime is malum prohibitum, it is inconsequential to prove that the illegal drugs
were delivered or transported to another person. The only thing that had to be proven
was the movement of the illegal drugs from one place to another.
