EQUITY CASE PROCEDURES

The objective with these pro se filers is to treat them just as we would any other
pro se filer. They can file in our court but they must follow the procedures and
local rules. Some things we have to watch for in their filings:

1. They must have an address and phone number and a way for the court to
contact them.

2. Ask them to fill out a civil cover sheet and tell us what type case it is.
Everyone is asked to fill out a cover sheet. They are no different.

3. Depending on how they fill out the civil cover sheet or if they just
explain what type case it is, either assign a civil number to it or a miscellaneous .J(.
number to it.
miscellaneous number means the $46 miscellaneous
filing fee applies and NOT the $400 - $600 fees for
4. Collect the appropriate filing fee. regular filings which get a CV number. See also Below.

/~ 5. Explain to them all documents go through the Clerk's Office and they are
processed and docketed like every other document that comes through the Clerk's
Office. Their documents are no exception.

5. If they want something sealed they must motion/petition the court and
explain their reasons for wanting it sealed. The Clerk will keep it private until the
court rules on whether to seal or not. If not, then the docket will be made public.
Please remind them the reasons for sealing in civil matters is very narrow and a
document is not sealed until the Judge makes a ruling. They cannot designate
what should be sealed and what shouldn't.

6. If they have documents in support of their complaint/petition for


declaratory relief, those documents must be numbered and must comply with
LR7.1-7.36.

KEY!!! MAKE SURE TO WRITE THE "Non-Statutory Petition in Equity" LANGUAGE ON YOUR COVER SHEET AND ALSO
IN THE STYLE OF YOUR PETITION. USE IT ON STATE COURT CASES TOO!
