DNA Test Can’t be used to as a shortcut to establish evidence of Infidelity

The Kerala High Court while hearing the plea of a 77 year old husband, ruled that DNA
Test can’t be used as a shortcut to establish evidence of Infidelity, which happened
decades ago.

The man had filed a plea after the wife confided that the three children belonging to
them are not out of their wedlock.

EPF Act is a Welfare Law

The Madras High Court observed that Employees Provident Fund Act is an welfare act
and courts must ensure that there are no undue delays in implementation of the
schemes.

Any Interested Person can petition assembly speaker to disqualify an MLA

The Sikkim High Court while pointing to the Rule 6 of Sikkim Legislative Assembly
(Disqualification on grounds of Defection) Rules, 1986, stated that not only a member of
assembly but any person interested is competent to petition to the speaker for initiating
the process of disqualification of a member.

The Kerala High Court while ordering the release of a girl child from Mahila Mandiram,
held that a victim cannot be stationed in children’s home, because of the possibility of
the access of the accused to the victim.
