Minerals Falling Outside the Definition of Nanomaterials According to Their Number
Size Distribution

On October 18th, 2011, the European Commission adopted a definition for nanomaterials. This
definition is a recommendation (2011/696/EU) to Member States, Agencies and Industry and is not
legally binding at this stage.

According to our internal assessment and in absence of any available harmonized methods, EP
Minerals, LLC Celatom® and Transcend® diatomaceous earth products do not fall under the EC
definition of nanomaterials. Although our products are not intentionally manufactured in the nano
scale, they may contain particles with one or more external dimensions in the size range 1 nm-100
nm.

EP Minerals, LLC is working with the appropriate trade and governmental bodies and associations
to provide industry-wide responses to this definition and implications arising from it.
