3. That in these circumstances, I started residing in Mata


Gulab Devi College Girls Hostel situated at 27, Shri Ram
Road, Civil Lines Delhi run by one Ms. Artee.

4. That while residing in the said Hostel, I found the said place
an ideal place for a girl student like me as I was provided
with all necessary facilities and comforts.

5. That pursuant to demolition of a major portion of the said


Hostel in July 2002 by the Government authorities, I had to
leave that place and am presently facing great difficulties
and have been virtually rendered homeless.

the ceiling limit on vacant land imposed by the said act.

6. That in the event of the aforesaid plot of land being declared as excess by the
Competent Authority under the Urban Land ( Ceiling & Regulation)Act. 1976, I shall
abide by the decision of the competent authority under the act.

7. That the said plot of land in respect of which the building plans as aforesaid has
been submitted to the Municipal Corporation of Delhi is not covered or affected by the
provisions of Urban Land (Ceiling & Regulation ) Act. 1976 in any manner whatsoever.

the aforesaid undertaking furnished by us with the Municipal Corporation of Delhi.

7. That in consideration of the Municipal Corporation of Delhi having agreed to


sanction of the building plans submitted vide our application ____________ dt.

MEMORRANDUM OF UNDERSTANDING

Invoice No. E 33618 & E 33620 each for USD 190, 467.20

As per the meeting held between Shri Dilip K. Kabra, Capt. P. P. Singh and Mr. Mahesh
Kumar/ Mr. Sahu on 11th day of March 1999, the following points were discussed and
agreed to implement by individuals on their capacity.

1) Mr. Dilip P Kabra will issue a letter to their bankers, Tamilnad Mercantile Bank Ltd
Mumbai requesting them to contact the overseas bank of M/s Mahesh Kumar & Co. Pvt.
Ltd., Singapore to confirm the withdrawal of the revised invoices and Drafts each for
USD 203,026.50 and to accept thee payment of the original value of the invoices each for
USD 190,467.20.

2) Upon receipt of such message from Tamilnad Mercantile Bank to Credit Agricole
Indosuez, Singapore, Mr. Mahesh Kumar/ Mr. Sahu will advise their bank to confirm the
following points:-

a) Withdrawal of the Revised Invoice and bill of exchange each for USD 203,026.50
b) Confirmation to accept the payment at the original value of USD 190,467.20 each
c) Collect interest as per rate approved by Reserve Bank of India from 19.01.99 to the
date of payment.

3) Mr. Dilip Kabra agreed to make the payments of the above 3 bills of Mahesh Kumar
& Co. Pte. Ltd. as per the following schedule:

a) First payment of USD190,467.20 on 22/3/99


b) Second payment of USD 190,467.20 on 6/4/99
c) Third payment of USD 190,467.20 on 7/4/99

4) Mr. Dilip Kabra will pay the interest payment along with the Invoice value.

5) Immediately after completion of the above 3 payments , Mahesh Kumar & Co. Pte.
Ltd., Singapore will remit the Commission @ 10% of the above 3 invoice value of M/s
Shree Laxmi Trading Corporation, Mumbai by T.T. to their bankers.

any point of time, that the above referred property or any part thereof is being used for

MUTUALLY AGREED TERMS AS FOLLOWS :
AND WHERE AS THE LESSOR IS AGREEABLE TO LET OUT THE DEMISED PREMISES TO THE
LESSEE FOR THE EXCLUSIVE RESIDENTIAL USE OF ITS PARTNER, MR. ANOOP R. VARMA
AND HIS FAMILY MEMBERS. WITH EFFECT FROM ……………………………… FOR A PERIOD

THE PREMISES WHICH WILL BE FROM THE DATE OF TERMINATION OF THE LEASE

PROPERLY HANDING BACK THE PREMISES WITH ALL THE FIXTURES, FITTINGS, FANS,

DEMAND CERTIFICATE’ FROM THE LESSOR.
THAT IF THE LESSEE SHALL DEFAULT IN PAYMENT OF RENT OR SHALL
COMMIT A BREACH OF ANY OF HIS OBLIGATIONS OR CONVENANT HERE
UNDER OR IN LAW, THE LEASE SHALL STAND TERMINATED AT THE
OPTION OF THE LESSOR AND THE LESSOR MAY RE RENT THE PREMISES
THERE UPON.
THAT THE PREMISES ARE LET OUT PURELY FOR RESIDENTIAL PURPOSES ONLY OF MR.
ANOOP R. VARMA AND HIS FAMILY MEMBERS.
THAT THE LESSEE SHALL NOT SUB LET EITHER IN FULL OR ANY PART OF THE DEMISED
PREMISES INCLUDING S-18, SERVANTS QUARTER IN ANY FORM WHAT SO EVER, NOR CAN
HE USE IT FOR ANY COMMERCIAL WORK, PAYING GUEST WILL NOT BE ALLOWED AND
ARE PROHIBITED.
THAT THE LESSEE SHALL PAY DIRECTLY TO THE CONCERNED AUTHORITIES ALL
CHARGES FOR ELECTRICITY AND WATER CONSUMED IN THE SAID PROPERTIES AND
OTHER CHARGES AND TAXES LEGALLY PAYABLE BY OCCUPANTS OF THE PROPERTIES
PERTAINING TO THE ENTIRE PERIOD OF OCCUPANCY. THAT THE LESSEE SHALL NOT
MAKE ANY STRUCTURAL ADDITIONS OR ALTERATION TO OR IN THE PREMISES WITHOUT
THE PRIOR WRITTEN CONSENT OF THE LESSOR AND THE MUNICIPAL AUTHORITIES
WHERE CONSENT MAY BE REQUIRED FOR THE PURPOSE UNDER ANY STATUTE , RULE,
BYE LAWS OR OTHER REGULATIONS OR ORDER HAVING THE FORCE OF LAW. IF ANY,
ADDITIONS/ALTERATION ARE MADE, THE SAME WILL BE LEFT OVER ON THE VACATION
OF PREMISES.
THAT THE LESSEE SHALL COMPLY WITH THE PROVISIONS, RULES AND REGULATIONS
HAVING IMPOSED FOR TIME TO TIME BY MUNICIPAL CORPORATION, STATE, OR CENTRAL
GOVERNMENT OR ANY OTHER STATUTORY AUTHORITIES WITH RELATION TO THE
DEMISES PREMISES.
THAT THE LESSEE SHALL NOT USE THE DEMISED PREMISES OR THEIR ADDRESS EVEN
FOR CORRESPONDENCE FOR ANY COMMERCIAL PURPOSE DIRECTLY OR INDIRECTLY. IN
THE EVENT OF ANY CONTRAVENTION’S TO ABOVE, THE COSEQUENTIAL MISUSER
CHARGES INCLUDING TAXES AND DAMAGES SHALL BE BORNE BY LESSEE. IT WOULD BE
IN ORDER FOR THE LESSOR TO CLAIM THE SAME WITHOUT DEMUR OR RESISTANCE FROM
THE LESSEE, IF THESE CHARGES/TAXES ARE PAID BY LESSOR ON BEHALF OF LESSEE.
ALL TAXES, CESS, PENALTIES, IN ANY FORM CHARGED BY MCD, DDA, DELHI
ADMINISTRATION OR ANY OTHER BODY/GOVT. DEPTT. BECAUSE OF
COMMERCIAL/PROFESSIONAL USE OF THE DEMISED PREMISES BY LESSEE SHALL BE
BORNE BY THE LESSEE ONLY.
THAT THE LESSEE SHALL BE RESPONSIBLE TO RESTORE/PAY FOR ANY BREAKAGES OR
DAMAGES TO THE SANITARY, ELECTRICAL AND OTHER FITTINGS & FIXTURES DURING
HIS TENANCY PERIOD. THE LESSEE SHALL BE RESPONSIBLE TO RESTORE THEM IN GOOD
WORKING CONDITIONS EXCEPT FOR NORMAL WEAR AND TEAR. THAT THE LESSEE
SHALL PERMIT LESSOR OR HER AUTHORISED AGENTS TO ENTER THE SAID PREMISES FOR
INSPECTION AND TO CARRY OUT REPAIRS, IF ANY AT REASONABLE TIME AS AND WHEN
NECESSARY.
THAT THE LESSOR SHALL PAY PROPERTY TAX AND GROUND RENT AS ARE OR AMY
HEREIN AFTER BE ACCESSED ON THE SAID PREMISES BY THE MUNICIPAL AUTHORITY OR
ANY OTHER CONCERNED AUTHORITY. THAT THE LESSOR SHALL CARRY OUT ONLY
MAJOR REPAIRS IN THE PREMISES SUCH AS MAJOR LEAKAGE OF ELECTRICITY, BURSTING
OF PIPES, CRACKS ON WALLS ONLY AND THE LESSEE SHALL DO ALL DAY TO DAY MINOR
REPAIRS AT THIS OWN COST.
THE LESSEE SHALL KEEP THE PREMISES IN GOOD CONDITION AT HIS COST. THAT THE
LESSEE HAS BEEN GRANTED ONLY TEMPORARY USE OF THE AFORESAID PREMISES FOR
THE USE OF MR. ANOOP R. VARMA AND HIS FAMILY MEMBERS FOR RESIDENTIAL USE
ONLY.
THAT THE LEGAL PROCESSION OF THE SAID ENTIRE PROPERTIES SHALL ALWAYS REMAIN
AND VESTED WITH LESSOR, THAT THE LESSOR AND THE LESSEE REPRESENT AND
WARRANT THAT THEY ARE FULLY EMPOWERED, AUTHORISED AND ABLE TO MAKE THIS
LEASE AND THAT THE LESSOR AND THE LESSEE WILL KEEP EACH OTHER FREE AND
HARMLESS OF ANY DEMANDS, CLAIMS ACTIONS OR PROCEEDINGS BY OTHER IN RESPECT
OF QUITE POCESSION OF THE PREMISES DURING LEASE PERIOD.

Garha Thana, P.S. Garha, Dist. Jabalpur, M.P. at present at New Delhi, do

hereby solemnly affirm and state on oath as hereunder :

1. That I am the respondent No. 1 in C.A. No. 3680/98 and Pairokar on

behalf of respondent no. 1, 2, 3 in C.A. No. 3679/98 and one of the illegal

detenues on whose behalf the writ petition is filed and am well conversant with

the facts and circumstances of the appeal under section 19 of the Contempt of
