FACTS OF THE CASE

On August 18, 2020 at about 9:00 in the morning, a sexual molestation incident
transpired at Purok 1, Brgy Lipacan, Malangas ZSP wherein the victim identified as
Raisah Estallo Adas, 13 years old, minor and a resident of Purok 1, Barangay Lipacan,
Malangas ZSP was sexually assaulted by the suspect identified as Romy Tonghay
Mariano, 50 years old, single, farmer and a resident of Purok 1, Barangay Lipacan,
Malangas ZSP. As a result, the victim accompanied by her mother Emelita Estello Adas,
42 years old, married, housekeeper and a resident of Purok 1, Barangay Lipacan,
Malangas ZSP together with Hon. Monap Sultan Tampipi, Barangay Chairman of said
place filed a complaint against the suspect.

Initial investigation conducted by this office disclosed that Raisah Estello Adas
was alone in her house when the suspect, who happens to be their neighbor,
confronted her and asked her to get inside the house. Reluctantly, she was forcibly
carried inside the house. Suspect then pinned her down the floor, forcibly undressed
her and kissed her repeatedly despite resistance and shouting for help. Suspect took off
his clothing but was thwarted when victim’s uncle identified as Edie Dayahon Estallo
responded and caught him. Suspect asked for forgiveness but Edie and victim’s mother
identified as Emelita Dayahon Adas immediately reported the incident to the barangay
officials. Suspect was eventually caught and was placed under arrest when he was
positively identified by the victim and witnesses as the sole responsible of the incident.
Suspect sustained visible head injury when turned over to this office. A case is now
being prepared against him while parties involved will be subjected for medical
examination in support for the filling of case.
